(CNSNews.com) - Judge Brett Kavanaugh, who was appointed to the U.S. Court of Appeals for the District of Columbia by President George W. Bush, accepted the assumption in a dissenting opinion he filed last October in the case of Garza v. Hargan that a teenage illegal alien caught at the border and put in detention has a right to an abortion in the United States.
At the same time, Kavanaugh conceded that this case presents a new situation not yet directly confronted by the Supreme Court.
Kavanaugh argued that in saying the illegal alien teen had a right to abortion in the United States he was accepting the governments assumption regarding existing Supreme Court precedents.
Kavanaugh did say that the majority of the appeals court was mistaken in saying the illegal alien had a right to immediate abortion on demand. [Emphasis added.] He argued the government could delay the abortion while seeking to find the illegal alien a sponsor.

His choices must have the broad support of a rather smart, well informed and high powered membership or he would be gone in a New York second, and without the support of the membership candidates forwarded to the President would go nowhere.
I don't want to take anything much away from him and making the Federalist society an influential advocate for rule of law / constitutional conservatives is a noble and creditable thing to do. But the power behind this so-called throne is a very very powerful membership.

All district court judges error when making their own decisions, when not doing their own due diligence directly on the Constitution itself, and the law but instead of that just take as “the law of the land” any Surpreme court precedent. That “precedent” applies to that court that made it alone, and no district court MUST acquiesence in it (accepting it can be over ruled) and no future Supreme court is bound by it either.

Yes. I only posted an excerpt, and it was cherry-picked. And yes, the Federalist Society is very influential. For example, if Don Willett, a Texan, is chosen to be the next Supreme Court justice, I will be surprised, indeed.
My prediction is that the next Supreme Court Justice will be Catholic and from the northeast. And I wouldn’t count out a woman with a very small record of court opinions.
We all know how Ginzberg and Sotomeyer will vote, and 90% of the time how Kagan will vote.

If you are counting like that, they gave you Thomas and Alito too.
Relax gang. None of the candidates has what I, or you, or the next guy would consider a perfect record, but they’re all at 99%.. Any of the top 4 are solid, solid conservatives, and more importantly there are no Souters.
How can one even make an argument for that?
A “precedent” is NOT the United States Constitution and no one set of Supreme Court Justices are truly “supreme”, only the Constitution, which other sessions of the Supreme Court can over-rule and that process begins with a lower court that makes an argument/case-decision outside of or against an early SCOTUS precedent. The idea that the Supreme Court justices are singularly the supreme law of the land, is an invention of a group of sessions of the Supreme Court and has no foundation in the Constitution itself.
