On Wednesday, Supreme Court Justice Anthony Kennedy announced he will be retiring from the bench at the end of July.
Kennedy, 81, has been a noted swing vote on the court with his decisions often determine the deciding vote on a court split 4 to 4 between liberals and conservatives even though he was considered a conservative, having been appointed by President Reagan in 1987.
Sotomayor may already be experiencing ESRD (End Stage Renal Disease) from her diabetes .. if rumors are to be believed. If so, then significant cognitive decline is not only possible but highly probable. However, I do not see her leaving the bench whilst she still has a pulse ... a la Ruth Ginsberg.
I agree on Sotomayor, Ginsberg will hang on for a while, Breyer and Thomas. Thomas will only leave if the senate remains in our hands
