Virginia Mother Jailed for Talking to Son's Doctors and Reporting Physical Abuse by Father

ALEXANDRIA, Va., June 18, 2018 /Christian Newswire/ -- A young mother was jailed Friday for reporting physical abuse of her son by the father to government authorities and for talking to her 10 year old son's therapist and psychiatrist about her medical concerns for her son.

Hard to believe? The court reporter transcripts reveal it all in Cases CJ 14001064 and 14001065 in Alexandria Circuit Court in Virginia. Her attorney is Jonathon Moseley (703) 656-1230.

Judge Lisa Kemler announced in her official decision before a court reporter that she was punishing the mother for making a report of the son's accounts of abuse to government authorities and for talking to her son's doctors, therapist, and psychiatrist.

Natalia Dalton's son told many adults (recorded) that his father physically abused him. She shows her photographs of her own injuries when she says Julio Lacayo beat her.

In November 2017, Natalia took her son to the Magistrate in Alexandria. The son met alone with the Magistrate for 15 minutes.

The Magistrate issued an Emergency Protective Order, ordered the child removed from the father's home, and sent the police to serve the father who was heard screaming in front of the son.

But the father yanked the son out of school the next day, and began to home school him, removed from any adults who could learn about the abuse and report it.

A month ago, a supervised visitation "monitor" Laurie Best appointed by Judge Kemler also reported the son's account of physical abuse to Child Protective Services. Laurie Best testified that in the trial (on the transcript) that what the son volunteered to her triggered her legal mandatory reporting requirements.

Judge Kemler refused to call the son to speak for himself and the father objected to the son being interviewed in chambers by Judge Kemler or to testify.

Natalia Dalton also warned her son's psychiatrist that the son was complaining that psychiatric medication was causing alarming side effects and making him irritable, forgetful, disoriented, and feeling weird.

In the court case, Natalia Dalton was accused and punished for warning the son's prescribing psychiatrist of side effects despite an earlier court order.

Natalia Dalton strongly and flatly denied ever sharing these concerns with her son, but only among adults treating him. There was absolutely no evidence or testimony that the son was affected.

Disobey a court order and they will get you. You have to get the order in question overturned or pay the price.

Congress should legislate some legal terms that spell “judicial negligence” and do so writing them in that legilsation as grounds for impeachment, as legally contrary to “good behavior” (that is all the Constitution provides for how long a lifetime appointment of a judges lasts - as long as it is “during good behavior”). They - Congress - should in the same legislation declare that judicial negligence constitutes failure to provide due process and thereby allow folks to take the lower court judges, in the states, to court in federal court, suing on those terms.

Unless I am missing pertinent facts, that judge should be whipped and then hung by the neck until dead.

It is not a judge's role to "punish" anyone. She overstepped.

On and around March 22, 2013 you posted a letter by Vice Mayor Andrew Macdonald – with a topic not necessarily popular in the City of Alexandria. There was mention of the fact the City is run by Democrats only. The comments I made on trying to stay with the subject matter of the Democrats running the City and making major decisions is that, after several of those decisions are made they then wind up in the courts . The courts are also run by the Democrats and with this it has created a corrupt Judicial System. I am personally a victim of this system but, I am not alone there are several other ME’s that have the evidence of how Corrupt the Virginia Judicial System is. The Circuit Court of Alexandria Judges (and I can only speak of the ones from September of 2007 to present – Chief Judge Haddock, now Chief Judge Kemler,that they also have the Support of the Supreme Court of Virginia – the JIRC, and the VSB – so they can rule in Favoritism and Cronyism instead of by the Rules and the Laws of the Supreme Court of Virginia, the Constitution of the United States of America, the Constitution of Virginia.

Something big is definitely missing form this article.

“Natalia Dalton’s son told many adults (recorded) that his father physically abused him.”

There is no way that even a corrupt judge would jail a mother if that’s the only thing out there.

I have to guess that what’s missing is that the court shows the mother has a history of making false claims of abuse (and against the doctors and even the courts) because she is trying to win a custody battle. There simply must be some reason her actions are being treated the exact opposite they would appear to need to be treated on their face.

Thanks for mentioning the “for the duration of good behavior” clause for judges. Everyone needs to know about this clause as it is the only thing separating us from a complete tyranny by the judiciary. Judges are not appointed for life, but most people have been convinced that they are. Violating the Constitution and law of the land constitutes “bad behavior”!!

There's a whole lot missing from this story and the way it's told is so one sided that it can't be taken seriously.

The state issued a Protective Order against the father, the father goes to the kid's school the next day and takes him out of school and he's not immediately arrested?

This story stinks.

But from the founders on, to protect us from judicial independence turning into judicial tyranny, we have done too little, in law, to flesh out some standards that define “good behavior”. I am frankly not satisfied with the only standard for “good behavior” the founders had in mind, which was that a judge themself had not committed a crime while they were a sitting judge. I think that is an insufficient standard. I think there is too much leeway and loohole areas in judicial discreation that permits judicial negligence.

I think there should be impeachment trials that through analysis and interrogation by Congress starts to lay out a body of judicial impeachment rulings that judges begin to realize set some limits on their discretion. They can then ignore them or see Congress apply them against them also.

There are a lot of effed up ‘families’ out there.

That said, the family court system is pretty effed up as well.

The Bible says to avoid going to court if at all possible. There is good reason for that advice. Unfortunately some are unable to work out problems for themselves.

I tend to agree...

Given the pro Mom/Female slant of family law, losing custody of a child by a Mother is a damn high burden to get. Given she has lost custody without far far more information that is offered here, makes me very skeptical of the veracity of the allegations, or the full context of the events.

On the flip side, that doesn’t mean a well connected and influential father has never worked the court system to have a good mother declared incompetent.

However the latter is far less likely scenario.

What I can say from this, is clearly there is a lot more information missing from this story, that is needed to pass judgement one way or the other.

the family court system is the most effed up part of law you will ever engage in...

There is no sanity or reason to any of it... its basically designed to dehumanize everyone involved.
