Attorney General Jeff Sessions told Breitbart News in an exclusive interview on Thursday that the Department of Justice was ending the executive branch legal activism of the previous administration, while also fighting the judicial activism of liberal judges. I think the department did become too political under President Barack Obama, Sessions said. Essentially, it was executive branch legal activism. They would take cases or regulations or statutes and expand or redefine the meaning of words in them to advance the agenda that they thought ought to be advanced an agenda that often had zero chance of passing Congress, where the elected representatives sit.
So you have an agenda, and you cant get Congress to pass it, so you use unelected regulatory officials and lawyers to draft regulations and enforcement policies that carry out a political agenda that the people dont favor.

There needs to be a system in place to deal with activist judges who rule by activism and politics over the constitution. A decision overturned by a higher court should go into a review process to determine the merits of the lower ruling. If it was political activism there should be a serious penalty.

Isnt that an understatement of Biblical proportions?

It is refreshing to see that Jeff awakened from his slumber long enough to have a blinding flash of the obvious.
“Activism” replaced by “inert”.
Great! Now, they just have to solve the problem of Judicial Branch Activism ....
Should be able to craft a law that covers the distortion of the intention of the law by judicial or executive fiat. The legislative branch needs to protect its Constitutional mandate.
Sessions can tout this all day long and it doesn’t matter anymore than a tick on a dogs ass.
It’s congressional oversight that’s supposed to keep this in check. Many of these agencies (if not all) have statutory authority, if they use that in an abusive way Congress must deal with it. Not the administration because it’s just going to revert back when another hostile administration takes over.
Would like to see Sessions go after the money misspent and distributed to all NGOs, and lobby for a law passed that moves fines and penalties directly to the treasury with no bounty no bonus, no asset forfeiture given out or kept.
One approach Sessions could take is to very publicly REFUSE to follow a single Federal judge, and force the issue to the Supreme Court EXACTLY on the basis that he is now publicly explaining.
I’m not sure whether good tactics says that you take the most important issue, or one of the least important issues.
And if Trump really believes he’ll soon have another Supreme Court justice to replace, not sure if better tactics is do it immediately to get the most time with the issue, or wait till a new justice is in place.
But the problem is to set the issue clearly enough that the Supreme Court HAS to address the core issue, rather than finding some hairbrained way to rule on some nit, which seems to be their preference.
But say that Sessions could get his refusal before THIS term, then he gets it decided before June, and the administration has 2 1/2 years to avoid being stymied by the one judge block.
DOJ Activism? You mean like Civil Asset Forfeiture? Oh, wait...
So true of almost all the alphabet agencies
Then you get some liberal activist who takes these regulatory policies as "gospel",
and become protective of these policies and agenda, by imposing a mis-interpretation of what constitutes law.
Sounds promising
He moves about as fast as a turtle, unless in has something to do with pot.
What about illegal activism?
There is.
It is called impeachment.
But the ‘Pubbies don’t have the balls to impeach judges, and they wouldn’t be able to get past Democrat partisanship.
