Michael Flynn FBI plea deal opens pathway to Donald Trump: Judge Napolitano

....The FBI’s evidence against the former general could put him in prison for 60 years, but making a plea deal could reduce his sentence to six to twelve months, Judge Andrew Napolitano, Fox News senior judicial analyst, told FOX Business’ Stuart Varney.

Napolitano said Flynn may have shortened his sentence by offering federal prosecutors some kind of link to Trump or someone within the administration.

“Sometime between Monday and today, they reduced that deal to writing. [Flynn] has real evidence that we can really use to prosecute someone, perhaps the president, we don’t know, and in order to lock the general in they got him to plead guilty this morning,” Napolitano said on “Varney & Co.”

Russia agreed not to retaliate with sanctions, because Flynn asked them not to, before Trump was sworn in.

If indeed he did that. And Russia agreed and changed their course of action due to a deal with the incoming Trump administration. How is that against the interests of the USA, which seems to be an element of the Logan Act?

It seems that would be IN the interests of the USA to me. I don't see how anybody can make a case that would be against our interests. Of course it has nothing to do with collusion to affect our election.

This is all a bunch of smoke but that won't stop the dums from acting like the sky is falling. Flynn may be our James Dean. At least it looks like he's trying to be.

I agree with Flynn, don’t misunderstand me.

Bottom line, he lied to the FBI, he is not charged with anything under the Logan Act.

I have no doubt whatsoever that Nap and Shep share a lot more than just the bathroom accessed only by their offices!

Nap’s job is probably in Shep’s contract.

The Constitution is Supreme not the Supreme Court. Any law that is repugnant to the Constitution is void. That’s basic Marbury v. Madison stuff. Any federal court can enjoin enforcement of an unconstitutional law. There are dozens of laws on the books that have been struck down by inferior federal courts that have not been reviewed by the Supreme Court. Further, doctrinal developments can show that a law is no longer valid even if it remains on the books and has not been specifically struck down. Prosecutors have an ethical duty not to pursue charges under unconstitutional laws. The void for vagueness doctrine is from the Supreme Court. It’s that reasoning that shows the Logan Act is unconstitutional under the Sixth Amendment. There is a reason that no one has ever been prosecuted under the act.

Nap has a very poor track record of predictions from what I’ve read over the last year.

It would be interesting if President Trump dropped a pardon on Flynn over the weekend.

Your client waives any right to have counsel present during these interviews and agrees to meet with law enforcement agents and Government attorneys outside of the presence of counsel.” Who agrees to meet with Mueller without counsel present?

Mueller obviously had the goods on Flynn, and could have charged him with something (I have no idea what) much more serious than this chicken$hit "lying to the FBI about something that wasn't a crime" charge. So Flynn agreed to plead and to become a snitch for Mueller against someone higher up. I don't know who but, if I had to guess, I'd say probably against Kushner.

This is the way white-collar criminal investigations work-- you find someone you can charge with something, get them to testify against someone higher up, then go to that person and tell them what they could be charged with, and keep repeating the process.

I guess all this makes some sense, as they wanted to get started on putting together a government and foreign policy. It's a little crazy that it's illegal to make plans in transition- isn't that what a transition is all about?

There's such a mania for the establishment to get to Trump, it seems to be lost in all this that the original charge of collusion during the campaign is all but forgotten; and all anyone is focused on is the sting run by the outgoing Obama administration with the assistance of the entire government intelligence community.

Question and this might be the wrong thread to ask it on but...the news is saying Trump was dealing with Russia as a candidate or pre-inauguration and there’s only 1 President at a time and Obama had him wiretapped or whatever. You get the drift. Well, then why is it ok for Obama to do a world tour now, going to all the same countries Trump just returned from? He’s going to China etc AND speaking to the leaders. Why is it ok for HIM but not Trump???

Flynn wasn't charge with conspiracy...just lying to an FBI agent.Presumably the agreement includes an assurance that no more charges will be lodged.

So precisely what major crime (or minor one) has DJT committed? And,of course,in any court proceedings Flynn can be asked "so,you faced as many as 50 years at Club Fed but were allowed to plead to a 6 month charge.Sounds like a good motive for you to imagine things that never happened,isn't that correct Mr Flynn?"

Still me get this straight... wasn’t it legal for the incoming administration to contact foreign parties to determine their vote on an upcoming UN vote. If so, why is everybody acting like someone directed Flynn to do something illegal?

Trump stalling cutting off this Special Counsel will eventually get him into real trouble. Turmp is acting like a real fool not closing Mueller down.
