Alabama Secretary of State: If State GOP Pulls Support for Moore and He Gets the Most Votes, Election Would Be ‘Null and Void’

On Monday’s broadcast of the Fox News Channel’s “Fox News @ Night,” Alabama Secretary of State John Merrill (R) said that the Alabama Republican Party can formally pull its support for its Senate nominee Judge Roy Moore, and if this happens and Moore still gets the most votes, the election would be null and void.

Merrill said Moore could withdraw from the race, or the state Republican Party could formally pull its support. He further stated that if that happens and Moore receives the most votes, “our election would be declared null and void, and Governor Ivey would have to call another special election, and we’d start the process all over again.”

Wow, if it gets to that, canceling the state wide vote after it happens is inviting people to vote with other than ballots.

The Founders’ original Constitution allowed the states to do what they wanted about picking Senators.
The 17th and the post-civil war amendments make this unlikely to hold in court though IMHO.

This interference in Alabama’s special senatorial election is one of the most sickening things I’ve seen in a long long time. Let the voters in Alabama decide who they want to elect! It’s nobody else’s d@mn business.

This despicable universal ganging up on Judge Moore with nothing more than 40 year old unsubstantiated allegations is evil, pure evil.

When it comes to elections for Federal office the Feds hold the trump card. Your rules must comply with their rules.

The state cannot nullify millions of votes. It would never pass a court challenge.

Equal protection and all of that.

The only question I have is what position in the Swamp has Mr. Merrill been promised. Cuz if he pulls this off, he will be movin’ on up in the Establisment Swamp.

If the last plug is pulled on Moore, can DJT fire Sessions, and Sessions can have his Senate seat back? If so, DJT should do that and then nominate a pit bull like Rudy to the AG position.

Moore can them run as an independent ? Southerners, you are still being occupied. It’s called the republican party.It’s hierarchy is made up of carpetbaggers and scalawags. If they do this to Moore. This is elevating a political party to the status of a government organ. It is also making the state government a mere arm of a political party. Whatever description fits best, this fusion of government and party is exactly the same way they did things in the Soviet Union.

Whatever happened to the will of the people, seeing as many of them have donated money to Moore’s campaign, and voted for him in the primary. How does the State get to overrule their primary vote?

I don’t believe “Republican” is written into the State Constitution of Alabama as a prerequisite for election, nor is party “support” for a given candidate. He won the special election, he’ll be on the ballot December 12 unless he withdraws.

The 17th specifies that Senators will be elected by popular vote. That makes this a Federal Election, held in the State of Alabama.

The dumb-ass SoS is full of sh!t. He cannot nullify the votes of millions under any circumstances. It’s a violation of the equal protection clause.

Since the election is already scheduled in accordance with state law, the democrats could sue to ensure it goes forward and every Federal Judge in the land would compel the state to move forward with the election.
