The U.S. Justice Department wanted this case to go away completely after President Trump issued his formal pardon of Arpaio. The problem here was that the timing of the pardon was terrible. The pardon was issued after Arpaio and his legal team had already filed a motion to have the conviction overturned. Rather than simply accept the pardon and go home, it was Arpaio and his legal team who insisted on pursuing the challenge to his original conviction.

Like I said ... the DOJ, and the judge in the case, would have been happy to walk away from the case. But since Arpaio insisted on going ahead with his challenge, the judge had to issue an order a few weeks ago that compelled the DOJ to file a response to Arpaio's challenge. Go figure.

Apparently they filed the only response that even came close to making any sense, in light of the circumstances. LOL.

And since Trump pardoned him in the mean time, the only thing the govt could do was re-iterate the Presidents official position.

Judge was the one who “tried Arpaio” all by herself. She was the reason he was convicted because she had her panties in a wad about “illegal’s rights.” The followup step should be to remove her from the bench, because all of this was about “her views” on illegal immigration which are counter to the laws of the country.
