I suggest Trump make three courts out of it.
Further I would like to see him use a lottery and demand two thirds of the current judges on the 9th Circuit Court, have to move to the other courts.
Each of the three courts would get 1/3rd of the current Ninth Circuit Court Judges.
To avoid the judges being able to plead hardship, I would keep the three courts centered in the same city they are now.
Thus they would not have to sell their property or leave family members behind. This takes away their ability to object on hardship.
Then all Trump would have to do is appoint 2/3rds of the justices needed for each court to be full, and you’ve just turned all three of the courts to the good side.
The Ninth hears too many cases. It needs to be split up.
As for people who might complain about it not being fair for jurisdictions to have to come to one of the three courts where they would remain, it would be the same place they always came. It shouldn’t make a difference.
That would be a great way to break up the 9th, the majority of the sitting judges couldn’t really put up much of a fuss.
The one that comes to mind that would blow his top would be Stephen Reinhardt and I’d love to see his face if it should come about. lol
