Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.
Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

As written, Utahs law only permits an officer to conduct such a test where he has reasonable grounds to believe that a person from whom blood is to be taken was driving while in violation of the laws regarding driving under the influence of alcohol or other substances. In this case, the detective specifically lacked any such grounds, because the draw was being taken to show the opposite that the driver was not under the influence. Utahs implied consent law did not authorize this particular blood draw under these particular circumstances.

The detective was defective no doubt... Some anger/control issues there or he had some other reasons for pushing the issue. I’ve seen some pissed off cops before, but never one threatening a nurse for doing her job. She even had printed out the policy for the detective. Talk about blind rage and monomania. I would have told the other cops to get the detective out of there as he was interfering in the patients care and safety. You don’t engage in conversation with a mad man, you redirect him from the area for patient safety.

But it’s not like law enforcement hasn’t been undercutting their own position like busy little beavers chewing off the branch they are perched on.
Payne stuck his neck out in a misdirected attempt to protect the thin blue line and promptly got it chopped off.
This should be a lesson for other cops about the dangers of overstepping their authority against higher caste members of the helping professions and to remember that there are always cameras everywhere in our new and improved surveillance society.

I didn’t say she was asserting someone else’s Constitutional Rights, she was simply following the federal law as regards taking a patient’s blood.

Nurses also rank near the top of the most respected professions. Certainly ahead of cops.
Believe the truck driver was unconscious. In this situation then the police had to obtain a warrant to draw his blood. The offices just tried to bully the nurse. She was legally right. YOU FIRED!
