You cannot take someone’s property without due process. Civil forfeiture is unconstitutional because it allows the police powers to steal property on the mere suspicion of criminal activity. To get it back, you must PROVE that you acquired it from legal means, which means hiring an attorney who will cost thousands of dollars. Most times charges are never brought against the victim of government theft.

The Founders used civil forfeiture- but they didn’t understand the Constitution?
Is that your position?

Or is it that the Living Constitution has changed since they wrote it?

The process is ripe for abuse but IMO it is unquestionably Constitutional because the Founders used it.
