Kennedy, 80, has talked with former law clerks and others about retirement, according to a story by CNN. The New York Times has reported that the Trump administration is already looking at its next nominee should Kennedy decide to leave the Court.

Kennedy has been considered the swing vote among the nine justices for many years. With four strong conservatives Samuel Alito, Clarence Thomas, John Roberts and the late Antonin Scalia and four equally strident liberals Elena Kagan, Sonia Sotomayor, Stephen Breyer, Ruth Bader Ginsburg it often fell to the moderate Kennedy to cast a deciding vote on a case.

I would consider this great news. Kennedy really betrayed us with some big ones. A reliable conservative in his seat would be a big deal. The Rats would look ridiculous if they go nuts on Kennedy’s replacement versus Ginsburg’s.

Yes, but if Trump serves two terms replacing Ginzburg is, surely, ultimately a foregone conclusion. And in that context, perhaps replacing Ginzburg first would be easier in the long run.Whenever Trump has a vacancy to fill, he should refer to his list - and, perhaps, ask the senators for advice on a selection from that list. Trump can and should argue that the list got him elected, and it is only proper that he limit his consideration to names which are on it. That position certainly puts the Democrat senators on the wrong foot if they undertake to say that they will fight tooth and nail against accepting any choice from a list of 20 who have all been vetted by the election.

When/if Trump nominates a very right-leaning person to fill any SCOTUS voids, I hope the Dems remember what they pulled with Gorsuch. If they expect any consideration from Trump after that, they’re nuts.
Mike Cernovich tweeted today that he has been told that Kennedy will announce his retirement next week.
