San Francisco judge to hear landmark motion against Trump policy defunding sanctuary cities

In a high-stakes case for cities and counties nationwide, a federal judge on Friday will hear arguments from Santa Clara County to block President Donald Trump’s executive order stripping so-called sanctuary jurisdictions of federal funding.

If Santa Clara County’s landmark motion for a preliminary injunction is granted, it would stop the section of the executive order applying to sanctuary jurisdictions from going into effect until the court rules on the county’s Feb. 3 lawsuit against the Trump Administration. The lawsuit has since been joined by dozens of cities and counties across the nation, questioning the constitutionality of withholding federal funds.

Expedite all these cases directly to SCOTUS. Also, move to impeach all judges not following the Constitution. That will make Libs run or become Martyrs.

I’m thankful Gorsuch is now on the USSC. I don’t think lawfare is going to work as well for the RATs as they had hoped. They might get some short term wins but in the end they will be overturned...unless Roberts goes rogue on us again, of course.

None of the arguments in the article explain how these jurisdictions are allowed to break the law without consequences. But I am sure this Judge will rule they can anyway.

The political views of one person now negate the duly enacted legislation and laws passed by the representatives elected by millions of people. How is this a democracy?

IIRC, there is a law on the books, approved by then DOJ head Loretta Lynch, and signed into law by Obama that would withhold funds from “Sanctuary” cities/counties/states. While Trump appears to be the target of this lawsuit, by withholding funds, Trump is just implementing the law, which is what he is supposed to do.

I agree, but I think that the Trump administration needs to get organized, and spur the creation of an ACLU counterpoint organization that could file similar actions, but somewhere outside of the 9th Circuit. Many of these issues will make it to the SCOTUS, and I am confident of what they will do once it gets there, but why not set it in motion in a friendlier circuit? Almost an inoculation, so-to-speak. Anticipate what they will argue, beat them to the punch by filing in AL, for example. The case makes it to the SC ultimately, but can be framed differently because it rose up from friendlier and more sensible courts below. The 9th Circuit is a nuthouse, avoid it.

How about just enforcing existing law and ARRESTING the mayors, judges, councilmen, police chiefs, and ANYBODY in violation of the EXISTING LAW!

I'd love to see the White House and Congress ignore any injunction and create a constitutional crisis. Our judiciary was set up to be an "equal" branch of government - not a superior one. If anything, Congress and the President, our elected representatives, are the preeminent branches of our government. It's high time Congress put the courts in their place.
