lol
Newsweak.
Pretty much settles it. Whatever they say, the opposite is true.
That was an excellent, comprehensive analysis. UA doesn’t have a legal leg to stand on.

Moreover the flight was not oversold. There were 4 non-paying employees who showed up at the gate after the plane had boarded. They were not booked, and were supposed to be on standby. Just the culmination of corporate and union culture that encourages employees feel contempt for the customers that pay their salaries.
If Amtrak ran an airline...
I wonder is United’s board members still think Munoz is worth his multi million dollar salary?
I would seek as part of the agreement the ouster of the CEO, plus the equivalent of a year of his salary and bonuses.
Nothing less will change the culture of disdain for customers at UAL IMHO.
hee come the entitlement police! only certified protected minority groups are allowed to be real protected minorities!

I thought boarding wasn’t complete until door was closed.
As I understand it, the plane was not “oversold”. There were airline employees who wanted to fly stand by. They had not bought tickets. Their employer had not bought tickets. The plane was not “oversold”.
Probably the airline employees needed so desperately to get to the next destination due to Union rules and FAA rules and for no other reason.
The article seems to try to knockdown a strawman fake news created.
Whomever wrote this is the usual know-it-all idiot that forgets the facts and the law.
Pilots are in command and can remove ANY passenger for ANY reason. Period.
BS
Well, if we want to get all technical about it, it wasn’t United, but an affiliate of United, Republic airlines, that deplaned Dao. Also, if the airline was using Rule 25, why did they bother to offer compensation?
And as for the client, his juvenile antics are clearly indicative of a deep and profound psychiatric disorder...as does his past history.

Did United Airlines act under color?
It strikes me as a question worth considering. Ordinarily, one private actor calling law enforcement to enforce private rights as against another private actor is insufficient. And properly so, otherwise everyone would act under color any time she called the police to remove trespassers or to protect her rights and things went sideways.
(interesting comments follow)
excellent legal analysis
yes, passengers are entering a contract with the airline
and what does United’s contract say
it says they violated their own terms of service
United needed to meet all the needs of its overbooked condition BEFORE boarding anyone; which in my experience is how it has usually been done.
Perhaps the airline will “disappear” this guy. They need to get in touch with the Clinton Foundation for instructions.
There is absolutely no provision for deplaning a seated passenger because the flight is oversold.
The man was already sitting in a seat that he already paid for.
Anything else — and I mean ANYTHING ELSE — is absolute bullshit.
Now I know it’s possible to come up with some kind of life/death/emergency scenario... but that’s not even being remotely hinted at here so please, let’s drop that non-argument and stick to the facts.
And there are only 2 facts.
He was already seated.
He had already paid for that seat.
There is nothing else. Period.
They offered as much as $800 to deplane with two takers. No other takers. The third person left when demanded to leave.
On another site, Reddit I think, a witness on the plane said another couple offered to leave for $1600 each and the stewardess laughed at them.
Bet United wished this only cost them an extra $3200 now....
