This is about where I am on this. A sigh of relief that the Court isn't in the hands of 4 libs plus the erratic Kennedy. I'll feel comfortable after Gorsuch chimes in on a 2A case the right way.
Hardly the case. True, the truck's trailer brakes were frozen and inoperable. True, it was unsafe to drive the trailer. So the driver unhooked the trailer, drove the fully operational truck cap to a rest stop, and saved his life. And got fired for it. He didn't break a law, he violated company policy.

The President appoints a Chief Justice. It's not a seniority matter and there is no requirement that the Chief Justice be selected from one of the sitting Associate Justices.

I can't come up with the posting right now, but yesterday there was a commentary on the relationship between Justice Kennedy, his family and Trump. It intimated that Kennedy may want to step down and allow Trump to name his replacement and that in some way, Kennedy's two sons (who are close friends of the Trump sons) are involved in the process. Kennedy was appointed by Reagan and he's been a swing vote on many rulings so he would not be the lightning rod that RBG would be should she be the next to go. Replacing Kennedy with someone more ideologically Rightist would further cement a Strict Constructionist Court.
Ted was grasping at straws to save his candidacy.
Ted remains a rock conservative.
