A Texas man was arrested and charged with a third-degree felony for allegedly shooting at two men who were attacking his fiancée outside their home.
Jeremiah Morin, 34, of Spring, is being accused of firing at the men indiscriminately, the Houston Chronicle reported Friday. The Montgomery County Sheriffs Office said the two men were still at large.
Morins fiancée was taking her children inside the home when two men in ski masks attacked her, deputies said.

My wife is a foreigner, Italian, legal immigrant. She has a carry permit in Arizona and Texas. She legally owns multiple firearms.
A crowded street in Texas, where a man has a woman in a headlock and he and his pard are dragging her and her kid off, and none of those witnesses/bystanders tries to help the woman and kid?
Not in the corner of Texas where I lived and worked for the better part of a decade.
That is what the police say, the forensic evidence and eyewitness testimony are matters for a trial.
This is why I have Texas Law Shield. If you fire your weapon their lawyers come to your defense, they post bail, counsel you and help you wade through the system. I can understand why he was charged. A good lawyer will put his situation in the best light for judge or jury.
If he really endangered bystanders, lucking out by not hitting and wounding one or more, tried to shoot the two attempted kidnappers in the back and repeatedly missed, and then threatened and intimidated the witnesses, it sounds like they could have charged him with impersonating a Texas cop.

This tells me that one should NEVER fire at a fleeing criminal. Assuming the shots miss the intended target, each miss could then be considered “indiscriminate” and the shooter would be subject to arrest. What about when a cop fires his weapon at a fleeing subject and misses, is he/she also firing indiscriminately?

I’d take a careful look at the situation before getting involved myself. The last thing I want to do is orphan my kids by getting between gangbangers settling a score.
Impossible to tell from the article exactly what happened. But if someone has your fiance in a headlock and your kids are also around, are you really going to open fire on the situation? This guy wasn’t in a sniper’s perch aiming at a still target.
He was arrested because he continued to fire even after the attackers had begun to flee.

NOT chasing and firing at them is baffling.
Thugs demonstrably able and willing to use deadly force being shot in the back while fleeing is the most rational policy in all cases.
Sure, they may no longer be a threat to you and your family, but allowing them to live or remain free simply exposes another family or random victims a few blocks away or even across town to be seriously or fatally injured instead.
How is that any kind of a rational policy?
Kill 'em ded and incrementally improve the safety of the neighborhood.
