Neil Gorsuch, President Donald Trump's U.S. Supreme Court pick, said on Tuesday that he would have 'walked out the door' if the chief executive has asked him to over-turn Roe v Wade.
The federal judge mounted a defense of his independence as a judge as he was questioned by senators, and also suggested that the 44-year-old decision that legalized abortion, is a powerful legal precedent that would be difficult to overturn.
Gorsuch said in his confirmation hearing that the landmark women's rights case has been reaffirmed many times.
'It is a precedent of the United States Supreme Court,' Gorsuch told the Senate Judiciary Committee, 'so a good judge will consider it as precedent of the United States Supreme Court worthy as treatment of precedent like any other.'
Trump said during his presidential campaign that he would appoint only anti-abortion judges to the high court, and predicted that the long-term result would be Roe's demise.
But Gorsuch insisted the case's status as a repeatedly defended decision 'adds to the determinacy of the law. What was once a hotly contested issue is no longer a hotly contested issue. We move forward.'
He was asked by South Carolina Republican senator Lindsey Graham how he would have reacted to a demand from Trump when the president was interviewing him to overturn Roe v Wade.
'I would have walked out the door,' he replied.
'It is not a judge's due. They should not do it a that end of Pennsylvania Avenue and they should not do it at this end, respectfully.'

That’s my issue. He doesn’t have to play his hand there, but statements like this or his one about Trump criticizing the judge who made the decision on his travel ban as “disheartening” ate too far and lead to my unease.
Would rather have a dem, in truth. When the dem attacked Trump it would just be on more. But when Graham attacks, the headline is "dissent within the fractured GOP". It's enought that the press can spin it into an illusion that he and McCain (and Flake and Corker to a lesser degree) are some sort of major group of dissenters.
I loathe him, because of what he keeps saying, which is a load of codswallop, weasel words, and sounds like he is NOT what his supporters claim he is, at all.

Nowhere did Gorsuch state that he wouldn’t vote to overturn Roe v Wade. Only that it would be a challenge to overturn it, and that he wouldn’t allow the President to tell him what to do.
The federal government will overturn Roe vs Wade when it is pretty much overturned at state level.
Whenever the media says there is “bipartisan opposition” of Trump, I just know, and am nearly always right, that said opposition comes from none other than McCain and his partner in crime Graham. That said, Graham is good for votes like on Cabinet picks and this Supreme Court pick, so he’s only slightly better than a Democrat.
That’s because we keep playing by their rules which state the rules only apply to Republicans. We should play by their standard.
Roe was decided on two main legal points:
1) that an unborn child was not a “person” for the purpose of being protected by or falling under the US Constitution. It was therefore the property of the mother;
2) that a woman has a right to privacy.
While the right to privacy is not directly enumerated in the Constitution, it is implied in the Fourth Amendment. Free people have always claimed the right. It pre-exists apart from the Constitution and thus is reserved to the People according to Amendment X.
Having said that, in declaring that an unborn child is not a person, the Court has used the same logic as it did in Dred Scott when runaway Negro slaves were declared to be the property of their owners.
Just as with same-sex marriage, liberals were in such a hurry to fabricate a new right that they did not care what logic they trampled underfoot. The issue could have been decided by the States. New York State had already legalized abortion when Roe was argued.
Yet another sad chapter in the history of the Supreme Court.

Roe v Wade is terrible written law re our Constitution. That said, abortion is here to stay forever. We all understand this, no? Just as murder and rape are here to stay forever, so will abortion always be here.
Doctors can say they are giving a woman a D&C when performing an early abortion. Doctors can illegally perform abortions, no back alleys needed. Back alleys will also still exist.
