Democrats tend to love sneaky lawyer tricks because their side is so good at them. The passage of Obamacare under the Senate rules governing reconciliation is the most prominent example of creatively applying the rules to get what they want.
But it turns out that there are some really smart and creative legal minds on the GOP side, and now that the GOP runs the Senate, the sauce for the Democrat goose also flavors the Republican gander, if that isnt too disagreeable an abuse of metaphorical license. Ted Cruz is one such legal mind; in the words of legendary Harvard Law School Professor Alan Dershowitz,
one of the best students I ever had.

Cruz is a reckless loose cannon. Bring it.

I read that this morning elsewhere but the GOP are too chicken to use any tactic that might actually benefit We The People and cave to the screaming and screeching of the Left that they are bastardizing the legislative process. Watch & See.
And YES I am still a fan of Ted Cruz even if it isn’t a popular thing to do around here. It was a brutal race. Politics is pretty much a blood-sport. We engage, we move on, we move forward to win the war not just the battle.
Anyone who thinks Turtle McGurtle and the Senate RINO contingent (which is most of them) would go along with this plan — brilliant though it may be — is smoking funny cigarettes.
Don’t know if you’re for or against Ted with your post :)
The primaries are over, ryan is a traitor, mccain said Trump should show proof of wiretappig or take it back.
If Ted can figure out a way to destroy the house plan, great.
They need 51 of 52 votes to pass it anyway. Lee, Paul and Cruz make that impossible.
And if Trump tries to twist their arm on it (I have NO IDEA what he is thinking as he is great and confusing folks on purpose) then I will feel let down by Trump.
Let me make clear that I NEVER KNOW what it in Trump’s head and I like that. Means no one else does either.
He may be saying the bill’s not so bad because he knows it can’t pass the senate.
If he can pull this off, he will officially be out of my personal doghouse.
The republican leadership in the Senate twist themselves into pretzels out of fear of what the democrats might do in the future. Fear not, for the democrats will use any trick available to them. Without hesitation. Therefore, Senate republicans should change the rules so that any matter before them, unless explicitly prohibited by the Constitution, needs only a simple majority to pass. It really is just that simple.
We have seen trump in action and he seems to always be a few plays ahead of the rest, like a masterful chess player and artful taction I just cant see him falling for this one
I was and am as strong a Trumpser as you were a Cruiser, but, feeling Cruz was an excellent second choice, never wanted to excommunicate Cruisers. Ted's a great lawyer, just where we need him now, and this is the first idea to come up that gives a really good shot at a proper repeal/replace.
Two things:
1. It’s still blowing up the rules and that means payback will be a b!tch if the Dems regain control
2. They won’t do it. Republicans never take risks like this to get things done, only Democrats do. Show me one example to the contrary.
I agree with you that the GOP will most likely find a way to cave.
As for Cruz, I think he behaved very badly during the campaign but since the election he has redeemed himself several different times. He is a good man and a good conservative and may end up doing some great things.
He apparently went temporarily insane during the campaign but as you say, we must move on and move forward and Cruz right now is a definite positive force on our side.
I have to really strongly agree.
This was one of his signature issues.
He knows he was set up by Ryan during the “pu##ygate” incident.
I hope/think he is playing ryan for a fool.
Wow, judging from a review of your recent posts YOU’RE CARRYING WATER FOR PASSAGE OF RYANCARE. It will be interesting to see how far you carry on with that mission.
Does the new bill need 60 votes, or will 51 do? Your post claims 51. Why would Lee, Paul and/or Cruz vote against it? If it only needs 51, who cares about Cruz’s creative solutions?
They would vote against it because it is a lousy, non-conservative bill coming from the house. All three have rightly already bashed it
Regarding Cruz’ creative solution, ask someone smarter :)
I was once admiring of Cruz’ knack for standing up to the GOPe but then he was assimilated into it; proof is in Jeff Roe and Neil Bush.
Cruz can be smart and stupid at the same time. As other Freepers have wisely noted, he’s too smart by half.
This case is a prime example.
Sure, Cruz can advocate VP Pence pushing the Senate Parliamentarian aside to rule what can and cannot be voted on in reconcilation.
The problem is that it blows up the Senate rules. We might think. well fine, blow them up already. But in future years it means the dems can play the same game.
But the real reason to tell Cruz to go fly a kite is that demolishing Obamacare by reconciliation leaves the damn law in place, leaves its blueprints on the books signed into law.
It can be wrecked, busted, demolished, crunched, whatever but it’s still a damn law of the land, just not in effect.
That all sounds good. But in future years, when the Republicans fail because they are stupid, and they are in fact stupid and spineless, the democrat carping about republican failures in healthcare will play into a frustrated electorate and the democrats will slither their way back into control of Congress where they will resuscitate the ACA and they won’t need to get 60 votes etc.
We need Obamacare REPEALED, not busted up in RECONCILIATION.
See the difference? It’s important to understand that repeal NOT EQUAL to reconciliation.
A repeal is a law to take down a law.
Reconciliation can make a law ineffective, but leaves the law in place.
What is needed is for the President’s AG to play hardball because it’s the only thing the Left understands and can be defeated by.
Here’s a hardball strategy:

Ted is by far a better choice then most of the GOPe cowards who are afraid of their shadows. Can’t believe how the GOPe cowers in the face of certain win.
>I hope/think he is playing ryan for a fool.
I sure hope so. Trump had repeatedly made political moves that turned out brilliant despite I and a lot of other people not having a clue about what he was up to.
I trust Trump, but Obamacare needs to go ASAP. It’s killing the middle class, so whatever Trump is about it needs to happen fast.
