Attorneys for a transgender teen who sued his school board for barring him from the boys bathroom said Thursday that they plan to continue to press his case before the U.S. Supreme Court, despite the Trump administrations decision to withdraw guidance on transgender students that had buoyed his lawsuit.
Lawyers with the American Civil Liberties Union, which is representing 17-year-old Gavin Grimm, said they believe federal laws barring discrimination on the basis of sex apply to transgender people regardless of the administrations position on the matter. They argue that in light of the fresh directive from President Trumps Cabinet which on Wednesday revoked guidance instructing schools to let transgender students use the bathrooms of their choice it is imperative that the high court rule on the merits of Grimms case.
If anything, the confusion caused by this recent action by the Department of Justice and the Department of Education only underscore the need for the Supreme Court to bring some clarity here, ACLU attorney Joshua Block said in a teleconference with reporters Thursday morning. Grimms case is scheduled for oral arguments in Washington on March 28.

So, she is graduating in a couple months?
The article didn’t mention that the Supreme Court takes about one percent of cases appealed to it.
Given the present make-up of the court, I think it’s most likely we’ll have unisex locker rooms for pre-teen public-school kids within the next calendar year.
Has this kid had a sex change???
If not, she is merely a girl who dresses like a boy...
IOW, a “cross dresser”...That’s it...
What a complete crock of nonsense. What have kids done for generations before this, without a “transgender bathroom”? What’s next? A transspecies bathroom? (”I think I’m a cocker spaniel today!”)
This is mental sickness being told it is alright, and encouraged.
Not to be a downer, but there’s no way the other side doesn’t have 5 votes. No way we win on this.
I put forth a compromise...
Any person who has COMPLETED the transition from one sex to another may use the restroom that matches their parts.
For a man.. that means he has to have had his penis removed.
For a woman.. that means she has had her breast removed and penis added.
Good luck getting your case before the SCOTUS....freak...
Trump has issued legal constitutional guild lines for this issue...
Why would SOTUS take the case when they are so many other important issues to rule on ?
But the kid says even though they have installed a single stall bathroom, he's not being treated like everyone else.
Well guess what....you are NOT like everyone else.
I agree.
This is one of the reason why we need “Loser pays”.
U.S. Supreme Court can’t wait to remove Women’s Rights ,not ,or can they

FR: Never Accept the Premise of Your Opponents Argument
Patriots are reminded that they need to reference every action and law of the corrupt federal government to a constitutional clause that reasonably justifies the action or law. If an applicable clause is not found then the law is based on nonexistent federal government powers.
So if ACLU attorneys were reading Free Republic, they would be able to advise the teen as follows.
The only sex-related right that the states have amended the Constitution to expressly protect deals only with voting rights as evidenced by the 19th Amendment. And since politically correct LGBT issues are clearly outside the scope of voting rights, the federal transgender bathroom policy is based on nonexistent federal powers.
Noting that the corrupt, RINO-controlled Congress should have stopped Obama from implementing his state sovereignty-ignoring transgender bathroom policy, patriots need to support Pres. Trump and USAG Sessions in working with corrupt Congress to remove unconstitutional federal laws and policies from the books.
And speaking of Congress
Drain the swamp! Drain the swamp!
Remember in November 18 !
Since Trump entered the 16 presidential race too late for patriots to make sure that there were state sovereignty-respecting candidates on the primary ballots, patriots need make sure that such candidates are on the 18 primary ballots so that they can be elected to support Trump in draining the unconstitutionally big federal government swamp.
Such a Congress will also be able to finish draining the swamp with respect to getting the remaining state sovereignty-ignoring, activist justices off of the bench.
Noting that the primaries start in Iowa and New Hampshire in February 18, patriots need to challenge candidates for federal office in the following way.
Patriots need to qualify candidates by asking them why the Founding States made the Constitutions Section 8 of Article I; to limit (cripple) the federal governments powers.
Patriots also need to find candidates that are knowledgeable of the Supreme Court's clarifications of the federal governments limited powers listed below.
Congress is not empowered to tax for those purposes which are within the exclusive province of the States. Justice John Marshall, Gibbons v. Ogden, 1824.
State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress [emphasis added]. Gibbons v. Ogden, 1824.
From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]. United States v. Butler, 1936.
You have to read to near the end of a very long article to find out that this is a girl who wants to go tinkle with the boys.
Go to the women’s bathroom when you need to go. Get help for your mental problems. End of story.
