Assault Weapons Not Protected by Second Amendment, Federal Appeals Court Rules

Maryland's ban on 45 kinds of assault weapons and its 10-round limit on gun magazines were upheld Tuesday by a federal appeals court in a decision that met with a strongly worded dissent.

In a 10-4 ruling, the 4th U.S. Circuit Court of Appeals in Richmond, Virginia, said the guns banned under Maryland's law aren't protected by the Second Amendment.

"Put simply, we have no power to extend Second Amendment protections to weapons of war," Judge Robert King wrote for the court, adding that the Supreme Court's decision in District of Columbia v. Heller explicitly excluded such coverage.

But when the 2nd Amendment was written the musket or Kentucky long rifle hanging over your fireplace was a high tech weapon of war for it’s time. Judges, truly the most tyrannical and liberty hating branch of the US government.

Ok, oh wise judge.

Now that you have defined these 45 types of weapons, AND 11 round magazines as ‘weapons of war’...

We should expect that law enforcement, to include all federal law enforcement and agencies, will NOT possess these weapons or 11 round magazines, right?

After all - they are ‘weapons of war’...why would our gubmint need them?

Very good point - colonial muskets were quite literally yanked from the fireplace and placed into service as ‘weapons of war’.

The Second Amendment to the Bill of Rights belongs to the American people not a bunch of GOVERNMENT judges. It’s up to us to tell the GOVERNMENT what these rights mean. It’s not up to the government to tell us. The Bill of Rights were written to protect the people from the GOVERNMENT.

My 1911, with a 7 round capacity is a "weapon of war" if one acknowledges that it was the official sidearm in its day - the "judge" is obviously a "Constitutional scholar" in the same vein that Obama is....I would wager that if his ruling stands, he will try to help expand it to any weapon ever used in war time....

Yes,it’s possible-with a lot if effort.FBI background check,fingerprinting,and a sign off by the local sheriff.BATF takes about 6 months to approve the transfer,but yea it’s doeable.

Its precisely why its there.

This country would not exist if it were not for the founding fathers using private weapons of war to fight. Private cannons they personally owned to fire on the british. The guns our citizens owned and used were cutting edge technology at the same level of british army troops.

We have to get rid of these country destroying people infesting this nation at all levels.

An “Assault Weapon” is any of those “scary looking black automatic machine gun rifles” that shoots bullets every time you pull the trigger...

Just ask the left...They’ll tell you...
