The Trump administration is filing paper work for an en banc hearing of the Ninth Circuit Court of Appeals that initially voted unanimously to keep the temporary restraining order on the president’s executive order on immigration in place.

BIG TIME MISTAKE. They are all nuts! Just rescind and re-write. IDK why Pres. Trump is perpetuating with this nonsense and setting the Executive up to be knee-capped by precedent that the 8 member SCOTUS will surely hand down.
Less than a month after being sworn in Trump is stumbling daily and NO, it’s not just the media narrative. It’s his inability to respond to this assault correctly. Guess he likes being cannon fodder for the lefties.
My suspicion is that now that the Virginia court has ruled he will simply play this out rather than issuing a new order. Most likely the VA appeals court will reverse so that if the ninth upholds the decision then he’ll have a conflict for the SCt to take jurisdiction.
The reason Trump is obeying these lunatic judges is because, unlike Obama, if he defies a judge he will be impeached.
They are just waiting for any opportunity to present itself, and it will start.

Makes sense. Replying to the Ninth costs little and may result in a win.
Not replying sets up a potential loss. Make them fight for it and show them to be partisan and stupid.
The Trump administration is simply following the judicial order from the 9th circuit - part of the legal document that announced the unnamed judge ordering the en banc. I think the deadline for the Trump team to submit the paperwork is Thursday. (I'm too lazy to google the doc.)
It may be a pretext to get support for breaking up the Ninth Circuit once they issue another terrible ruling. They are overruled 80% of the time by SCOTUS.

There is a chance that the full court will say there’s nothing wrong with the executive order. The problem is the idiots reviewing the visas who never actually read the rules.
