The Environmental Protection Agency announced Friday it will not repay claims totaling more than $1.2 billion for economic damages from a mine waste spill the agency accidentally triggered in Colorado, saying the law prohibits it.
The EPA said the claims could be refiled in federal court, or Congress could authorize payments.
But attorneys for the EPA and the Justice Department concluded the EPA is barred from paying the claims because of sovereign immunity, which prohibits most lawsuits against the government.

I’m not arguing against what you say or pro EPA
I observe and produce a finding. The finding is that total elimination of the EPA is not seen as a political reality.
Having said that there are lots at EPA that better be developing a resume because they are going to be gone
Can’t pay? Well, I guess EPA precedent means seize all their assets.
Withhold the paychecks for EPA employees until $1.2 billion is reached, then pay the damages.
“sovereign immunity”.
Reminds me of the second(?) Lethal Weapon movie where the old German guy says “I declare diplomatic immunity”,
and Danny Glover shoots him between the eyes and says “And it’s just be revoked.” (Or something).
Anyway - a suitable metaphor for the EPA.
Where’s that Exxon money?
How is it not a political reality?
So long as that doesn’t leave any remnant that would permit it to grow back like a cancer.
every state has its own EPA
there is no need for a federal
EPA
Stop funding. I like the Bob’s strategy from Office Space, just stop the paychecks and the thing will work itself out naturally.
Take their property, cars, real estate, machines,.....anything of any value which could be sold, even for scrap.......a judge should render a judgement. Try the head of the EPA and anyone who worked on the project.
Sovereign BUMP
Perhaps, a tattoo on the forehead of all of those involved would be a good start. At least, keep the visual on their mind every time they use the bathroom.

The Law? What Law?
Anyways when did the EPA start caring about laws?
——How is it not a political reality?-—
The EPA is like NPR and other sacred cows. It is protected by sand bags, a moat, more sand bags and layers and layers of barbed wire.
The political cost for assault is just too great for the trouble and capital expenditure.
The EPA did not sell baby parts.
However, the EPA produces regulations that can and will be eliminated or scaled back.
SOB sit around making up excuses to fine or restrain US citizens and cost companies billions then plead poverty when they have to deal with the consequences of their own actions.
That's not an agency of a government answerable to the people, that's a class of Nobles who claim they're exempt from the law because they're superior to the law.
State “EPA” is fine as long as it isn’t a branch of the unconstitutional federal EPA. Environmental issues are states’ issues. The Constitution gives the feds no authority over the “environment”.
The EPA and the rest of the 70%-80% unconstitutional portion of federal government is there for one reason and one reason only: more government power. Greater paychecks for government officials, bureaucrats and workers. That’s all.
Fine. Just go to the offices, homes and businesses of anyone connected with this. Confiscate their autos, bank accounts and personal property for compensation. Isn’t this what the IRS does to those who aren’t able to pay their tax bills?
Ask IRAN. Perhaps they can loan the EPA some of the money 0dungheap happily and illegally gave to them.
A month ago the news was full of stories about how Obamacare was going to raid a fund set up for the specific purpose of paying for cases like this.
Now, that’s forgotten?
Made sense for hundreds of years but two things are different now. First, everyone sues everyone all the time, courts are the forum for settling disputes, years ago one couldn’t even claim a cause of action for suits that now, regrettably, carry the day.
More importantly however is that government does EVERYTHING now. Sovereign immunity would never even have risen in the past. No such construct as an EPA would be on a bulldozer breaching a mine and ruining a river. Government wanting to change our diapers doesn’t deserve Sovereign Immunity.
