Montana's attorney general's office has been unable to find legal grounds to challenge a judge's decision to send a man to jail for 60 days for repeatedly raping his 12-year-old daughter. The amount of time behind bars, considered lenient by many, is 'reprehensible' but that alone was not enough to appeal the October 4 sentence issued by District Judge John McKeon, State Department of Justice spokesman Eric Sell said Monday.

Gee judge, you think you were a little too rough on the guy?
From what I read when this first happened, the mother was asking for leniency. Poor girl.
His church rooted for him too.
If the story is truthful, this is a two-rope situation.
Surely there is a greater penalty in Montana than 60 days for a conviction on a Statutory Rape charge. And multiple charges? And convictions? Sentences to be served consecutively?
Actually, that little bit of propaganda has its origins with pervert entomologist Alfred Kinsey. The construct serves a dual purpose - it elicits sympathy for Perverts who sexually assault children (they are victims too)and works to silence actual victims (because people now believe being raped by an adult causes them to become child rapists) and this was the intent.
Alfred Kinsey operated within the same academic standards as Margaret Mead. Which is to say they made things up and the education system the vigorously taught their bogus assertions.

The author worked as a researcher in the prison system for many years before retiring and becoming a fiction writer. I had some of her college textbooks, but those are a bit pricey.
Under Montanas laws, rape is called sexual intercourse without consent and the crime includes statutory rape. A person who engages in sexual intercourse with a child under the age of 16 commits the crime of sexual intercourse without consent. The crime is punished more severely if the defendant is four or more years older than the victim, and rape of a child under the age of 12 is punished very severely. For example, anyone who has sex with a 15-year-old could be convicted of statutory rape, but a 25-year-old could be punished with a longer prison term than a 17-year-old.

Sexual intercourse without consent is punishable by two to 100 years or life imprisonment, and a fine of up to $50,000. If the defendant is at least four years older than the child, the crime is punishable by four to 100 years or life imprisonment and a fine of up to $50,000. If the child is under the age of 12 and the defendant is over the age of 18, child rape is punishable by a mandatory minimum term of 25 years.
Sexual activity short of intercourse with a child under the age of 14 is usually punishable by four years' to life imprisonment and a fine of up to $50,000. If the judge finds good reason to do so, the judge may make written findings and impose a term of less than four years.
In addition to prison sentences, Montana also authorizes chemical castration for some sex offenders.

So...how does the judge in this case think these laws and sentencing do NOT apply?
Inform his fellow inmates exactly who he is and let them have some fun. Sixty days can seem longer than twenty years if it’s spent in Hell.
Behind bars on the weekends and out the rest of the week to do whatever to whomever. That’s two weekends for each year of the girl’s life. Real harsh there, judge. Makes one wonder why the judge is showing such sympathy for the guy.
This. It’s my hope that the guards, like a liturgical procession, announce his name and crimes as they walk him to his cell.

How do they protect the daughter from the father when he gets out next month?
And what about her rights? She is forced to live in fear for the rest of her life at home?
How about one better? Just maybe a lynch mob on the inside of the jail may be waiting for him. It’s called “inmate justice”. As soon as the inmate find out what he’s in for their gonna have a “field day” with him. That’s one of the things about inmates, you can murder, rob, steal but you rape or molest a child and their vengeance will be a water fall on him. There’s a good possibility he won’t make it out alive and if he does he be carried out on a stretcher or rolled out in a wheel chair.

another factor is that these are very likely Indians, close to the rez....I’ve heard that pedophilia is endemic in these places....I’m sure this in just another wink and a nod....
