The Senate Armed Services chair vowed to help move Mattis through the upper chamber's confirmation process. McCain, who will chair Mattis's confirmation hearing, told the Washington Examiner that he would write the bill to grant Mattis a waiver of the seven-year rule.
Not all lawmakers agreed on that Thursday night. Sen. Kristen Gillibrand, D-N.Y., a former Hillary Clinton supporter, said she is against changing that rule in order to accommodate Mattis.
"While I respect Gen Mattis's service, I oppose a waiver-civilian control of our military is a fundamental principle of American democracy," Gillibrand tweeted.

Shut up and sit down, woman!
I think I remember reading somewhere, something about our first President having been a General in the Army. Maybe I`m mistaken. But then again, the didn`t have the seven year rule back then.
Eisenhower was a general. :)
fine. the common sense clause — that seems unnecessary in the first place. my post was missing a word, but it’s point wasn’t the primary problem that this thread is/was having.
Marshall received a waiver when he was re-appointed Sec Def in 1950, just as Mattis must receive a waiver now.
“the waiver isnt required, because the infringement upon the presidents authority to nominate whomever he chooses is almost certainly unconstitutional”
On its face I would think the same thing. But it would not be unconstitutional to make the law’s requirements part of military oaths. In other words it could be illegal to ACCEPT the nomination.
`Eisenhower was a general`
Good point. I don`t know how we managed to survive before the seven year rule. Lol.
Me either, but we might just get a chance to see. :)
Eisenhower was a General of the United States Army and a United States President.
And let's not forget Ulysses S. Grant, General of the United States Army and a United States President.
Leni
Cover that THING up! Pahleeze!
Anyone care to ask this liberal twit what her thoughts are on all the Obamacare Waivers granted to “select” groups?
I swear, Democrats are so stupid.
I can’t believe there hasn’t been a firestorm over Obama/Dems wanting girls to register for the draft (now that they can be sent into combat).
Nobody has said a peep. Before Clinton this would have been unthinkable.
Incredible.
Marshall was State not Defense.
The same waive issue existed, though, and the waiver was granted by Congress.
big OOOPS, I was thinking of when Gen. Marshall became Secy of State, but I did not know he later became Secy of Defense as well. Wow, learn something new every day!
Kirstin Gillibrand is an outright anal orifice. I can’t think of one single thing she’s done for NY all the while she’s been in Congress. She is just a shill for the Dumbocrat party line. They probably flipped a coin or drew straws to see who would be the one to protest waiving the 7 year post retirement requirement for the post, and she was “It”.
oh, I get it now. according to the nypost, she’s thinking about a run in 2020. since she’s been a total non-entity up until now, she has to go full-firebrand starting today if she wants to endear herself to the lunatic donors and equally insane dem base.
While I ultimately believe we shouldn’t have been there, a Mattis in 2003 would have had a better strategy for Iraq and its aftermath.
Great find that invalidates their argument!
Please, General, when you get up there clean house and get rid of Obama’s generals.
