President Elect Donald Trump put out an interesting tweet this morning: "Nobody should be allowed to burn the American flag - if they do, there must be consequences - perhaps loss of citizenship or year in jail!"
Maybe some 4-D chess going on? I also found this, Trump's Tweet coupled with a "Flag Protection Act" bill that none other than Crooked Hillary Clinton introduced to the senate floor in 2005.
Anyway, this should provoke some interesting discussion as well as another meltdown from the Left.
For too many, it appears outlawing flag burning is only a liberty issue if it is something Obama or Hillary proposes.
“It is illegal to burn a Mexican flag in the US. You get charged with a Hate Crime.”
Can you show us a instance of someone being charged for that?

Maybe burning a personally owned flag could be what the jurists defined as first amendment protected speech, but I believe the flag in question flew at the school, owned by the school and the patriotic students took umbrage, tore it down and burned it. Absolutely no coverage by the supreme court ruling IMO and Trumps suggestion to yank citizenship for these morons (if they even are citizens) could be useful in ridding us of vermin of that caliber.
I agree with Trump...deport them if they are foreign born or anchor babies.

If that is the case, then burning the US flag per se isn’t the issue . It is taking someone’s property and destroying it with fire in a protest. Take out US Flag part of the equation and insert any other sort of flag to look at the legality.

Burning the US Flag is the ultimate act of stupidity by a US citizen. However these idiots should be allowed to be stupid so they are known for who they are. Also burning any other flag or document should be ok as well with no allegations of hate speech being made nor enforced. Allow stupid people to be stupid- let them out themselves.

The Constitution mandates that the President elect take this oath.

A statute requires representatives in Congress to take this oath.

A statute also requires Commissioned military personnel to take an oath.

The oath for enlisted military personnel repeats the preceding affirmation, "that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same,"
and concludes with,
"I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God."
The subtle distinction between officer oath and enlisted oath is that officers are bound to disobey any order that violates our Constitution, while enlisted personnel are bound to obey only lawful orders.< p>

One thing that distinguishes conservatives from liberals is that the former understand the difference between "things that make me mad" and "things that should be against the law".

The Supreme Court has always treated political speech in a generous way, since it’s so fundamental to the First Amendment and to the functioning of an open and free Constitutional republic. Scalia used to joke that his wife wouldnt speak to him for a few days after he was the deciding vote in the flag burning case. He was a great thinker and a great wit. He can never really be replaced, but thank God Hillary isnt the one who gets to try, regardless of the flag burning issue.
Some years back when flag-burning was a hot issue—it comes around every few years, I guess when self-proclaimed “patriots” require self-gratification—I put all I care to say about the subject on my FR profile page.

Antonin Scalia was the most conservative justice on the Supreme Court, a brilliant legal mind and big defender of our Constitution, and a good and outspoken Christian. Your comment wishing him to burn in hell was absolutely sickand to think you probably agree with 98% of the things he stood for. Don’t you know how many leftists said similar things online after Scalia’s death as you did? Would you be happier with Sotomayor or Ginsburg? I never thought I’d see something like that about Scalia on a conservative website—never.

I understand and respect the citizenship's right of free speech... but with limits such as yelling "fire" in a crowded theater. There should be repercussions for citizens who freely choose to make a choice of burning the US flag... if you are receiving Federal/state funds... then you should be fined as per the flag burning statue quoted in this thread.
And there is nothing in the SC's decision of free speech rights for "illegal" immigrants. If convicted of burning the flag, they should be deported to their origin as soon as possible with no possibility of US citizenship for life.

If this was after the Supreme’s decision then this is Free Speech and he’s guilty as sin, free as a bird!
