There is nothing in the Constitution stating how many Justices shall be on the Supreme Court, only that Congress may “advise and consent”.
Congress is “advising and consenting” to 8 justices.
Deal with it.

Nothing was stolen. Obama got to make his nomination.
The Senate advised that it was best to let the people decide in the upcoming election, so consent was deferred.
