And when the case comes to trial I’ll side with the property owner and nullify the other jurors.
OK, well you asked what I thought to be good-faith questions and I’ve given you good-faith answers from my understanding of common law.
Given those answers, I’m not sure what you dislike unless you think the electrified sign is not dangerous or deadly. That might be possible, but as I said, the law generally frowns on devices rigged to harm. It’s an issue of unlimited justification of bodily harm to protect property which, as I said, has been hammered out in common law over the centuries and I think is generally reasonable and good.
City boy didn’t know what happens when one urinates on an electric fence line.
So would you rather the property owner had shot and killed the trespasser as is allowed under the laws in some locales? (very rhetorical)
...unless you think the electrified sign is not dangerous or deadly.
Ah, the stipulation amongst carefully chosen words!
Dangerous? (able or likely to cause harm or injury) To a small degree it is. Many things in life are "dangerous". Do you still pick blackberries despite the danger of the thorns? (rhetorical)
Deadly? HA! Even small animals are not killed with such systems.
Well, that’s why we have courts, so individual controversies are solved - determining things like whether the particular electrified sign in question is dangerous enough to be considered per se illegal. Might be a close call, but generally I think courts frown on devices rigged to hurt someone especially if there is no warning sign.
Maybe the point is prudence would be on the side of putting up a warning sign. Otherwise it might be argued you wanted to see the guy trespass and attempt to steal so you could hurt him.
Come on, shake! It'll only hurt a little!
OK, as long as it’s not the hand-shake buzzer the Joker used to fry the bad guy in the Jack Nicholson/Michael Keaton “Batman” movie.
:)
Even a fool knows to look both ways before crossing a busy street.
And with that you've as good as admitted that you were trying to bait me with your "dangerous or deadly" comment above.
You know the difference and yet you still tried.
Again, it’s not me, it the common law recognized in most states.
Agreeing with it means you prioritize threat to bodily harm over threat to harm to property and does NOT mean you don’t respect property, It means you to place a higher value on life than property. I agree with that. It certainly doesn’t mean you don’t have respect for property which I and the common law certainly have.
The law sees rigged devices as a kind of lying-in-wait for their victims, including the trespasser as the victim. Maybe you think its OK to lie in wait to catch and physically hurt the trespasser, but your ownership of property doesn’t give you unlimited rights against the trespasser and that does NOT mean a disregard for the value of the property. That’s why the picture of justice is one blindfolded with scales. You have to weigh the value of these things in the balances of justice regardless of personal bias.
Dang, man, you’re too paranoid. “Dangerous or deadly” was quoted directly from the common law notes I have. It’s the common law of torts and criminal law. Nobody’s trying to “bait” you.
If you can’t take what I’m saying in good faith the way its given then we should just leave it at that. This is a subject I enjoy talking about but not with someone who isn’t taking the discussion in good faith.
Voltage pushes current... you get zapped by the current. What does a defribrillator use? Something in the milliamp range?
Doesn’t take much amps to stop the heart, correct?
So whatever the homeowner ran through it, it was enough to light him up a little bit, but not kill him.
“What does a defribrillator use? Something in the milliamp range?”
We now start at 360 Joules (watt/second)
Regular house current of 110 VAC has shaken me up dozens of times.
Brother, are you going to make me try to remember Ohm’s Law now??? :^) Haha!
Power (P) = Voltage (V) x Current (I)...
also Power (P)= Current (I) Squared x Resistance (R)
Something like that...
You ain’t alone there, Cobra... Had my share of zaps too. Getting lit up sucks.
