A liberal Court could end long-term solitary confinement. It could mandate better prison conditions in general, making it more costly to maintain mass incarceration. It could conceivably end the death penalty. It could uphold tough state campaign finance rules and start to move away from Citizens United. It could start to develop a robust right to vote and limit gerrymandering. It could strengthen abortion rights, moving toward viewing abortion rights as a matter of equal protection for women.
If Donald Trump wins in November, this is all moot. But if he loses, as polls increasingly indicate, the dawn of a new era of liberal jurisprudence could be upon us.

It's not always easy to encapsulate an idea in very few words.
Nirvana awaits the liberals. Shame they won’t ever get it. Humans are like that.
One big problem I have with Hillary winning in 2016 is that even if we prevent her reelection and dominate 2020, the Congressional maps that conservatives draw as a consequence of 2020’s results would be challenged and nixed by Hillary’s Supreme Court appointees.
2016 is do-or-die for us. We lose, and it’s game over. And I’m not sure that the NeverTrump crowd has figured out that it’s not enough to lose in 2016 and then elect one of their preferred guys in 2020: by 2020, it’ll be too damn late. She’ll be gone, but her and Obama’s judges will remain with us for the next few decades. She will have left her curse upon us for the next generation.
She must be defeated.
And hopefully, the Governors and Legislators of the Southern, Midwestern, and Mountain states, say F*CK IT..and start the secession process. Those that want to preserve and fix this country, that is.
If that happened, I wonder how fast the West Coast, DC and the Northeast would fall into total ruin.
My biggest problem with the line of thinking in the article is that the author, along with darn near the whole country both left and right, has fully accepted the idea of the Supreme Court as a super-legislature. What the hell do we have a Congress for if the Supreme Court can change, invent, and re-interpret laws at will? We should already be rebelling against the unconstitutional usurpation of power. 9 robed idiots cannot decide what is and is not law for the entire country. That was never a power given to them.
I’m a boomer and my generation has a lot of blame. But the rot began long before we came around.

Yup - in 2008, 7 out of 9 justices were Republican nominated. And on Roe vs Wade, 5 of the voting 7 were Republican appointed. 2 of Reagan’s appointees also voted to uphold Roe in 1993. My faith in republican justices is about 15% (vs 0% for Ds)
