If an official state publication does contain language similar to the above excerpt from the OP, then this is evidence that misguided, low-information, pro-LGBT activist state officials are unthinkingly violating the Constitution’s Clause 1 of Section 10 of Article I. The Founding States made that clause to prohibit the states from establishing privilege / protected classes.

There us no justification for an arbitrary subdivision of concepts. There must be some essential characteristic that distinguishes a third gender from male and female, and requiring special study, in order to make a new concept necessary.
