To be clear this is not to suggest that in similar circumstances a person who engaged in this activity would face no consequences. To the contrary those individuals are often subject to security or administrative sanctions but thats not what were deciding here.

3. TRANSMISSION OF TOP SECRET INFORMATION. Top Secret information shall be transmitted only by:
a. Direct contact between appropriately cleared persons.
b. Electronic means over an approved secure communications system (i.e., a cryptographic system authorized by the Director, NSA, or a protected distribution system designed and installed to meet the requirements of National Security Telecommunications and Information Systems Security Instruction (NSTISSI) 7003 (Reference (ay))). This applies to voice, data, message (both organizational and e-mail), and facsimile transmissions.
c. The Defense Courier Service (DCS) if the material qualifies under the provisions of DoDI 5200.33 (Reference (az)). The DCS may use a specialized shipping container as a substitute for a DCS courier on direct flights if the shipping container is sufficiently constructed to provide evidence of forced entry, secured with a high security padlock meeting Reference (ap) specifications and equipped with an electronic seal that would provide evidence of surreptitious entry. A DCS courier shall escort the specialized shipping container to and from the aircraft and oversee its loading and unloading. This authorization also requires that the DCS develop procedures that address protecting specialized shipping containers in the event a flight is diverted for any reason.
d. Authorized U.S. Government agency courier services (e.g., Department of State Diplomatic Courier Service, authorized DoD Component courier service).
e. Appropriately cleared U.S. Military and Government civilian personnel specifically designated to carry the information and traveling by surface transportation.
f. Appropriately cleared U.S. Military and Government civilian personnel specifically designated to carry the information and traveling on scheduled commercial passenger aircraft within and between the United States, its territories, and Canada.
g. Appropriately cleared U.S. Military and Government civilian personnel specifically designated to carry the information and traveling on scheduled commercial passenger aircraft on flights outside the United States, its territories, and Canada.
h. DoD..................more.
Granted this is within DOD but both State and DOD fall under the same LAW regarding USG classified material. I don't know how to find State classification directives but IMHO State follows very similar rules/laws particularly with regard to electronic transmissions. I contracted with NSA and that agency makes the RULES for transmissions (Check out Reagan and STU-III).

This was a gift. Pure and simple. By outlining in detail the rationale for indictment, but not recommending indictment, Comey did us a great favor. Some points:
- The hildabeast, if indicted, would be prosecuted in DC. The chance of getting a conviction there are nil.
-The hildabeast is by far the weakest candidate the rats could be stuck with. If she was forced to step aside, we might face an opponent that actually had some charisma or some faint veneer of ethics.
-This hands a great campaign theme and opportunity to appear Presidential for Donald Trump. He could give a great speech on the need to restore the rule of law.
- Ultimately it forces the issue to be resolved in the political realm where We The People have a chance of prevailing, rather than the court system where we have zero chance of prevailing.
- It fuels the theme that the system is rigged. And a candidate who can plausibly argue that they will act to correct that will have the upper hand.

Comey's argument about "no reasonable prosecutor" was prefaced with a remark about 793 case law.
Mark my words, the talking heads are going to go down the 793 rabbit hole. It's what they do. Comey put the bait there, they'll take it.
I'm totally cynical about the law - the law is a powerful farce used by powerful people to suit their own ends. Selective enforcement, use as a political weapon (lawfare), out of thin air orders from courts. Entertaining, and logical once you realize it is all result oriented (pick the outcome first, then pick the law that delivers that outcome). I respect it becuase it is ruthless, not because it is just.

It completely negates his lame rationale for not recommending prosecution.No, I think he's being clever. He's saying her behavior was bad and she should face some consequences, just not criminal prosecution.
