GOP rep: Trump’s Muslim ban ‘unconstitutional’

Rep. Tom Cole (R-Okla.) on Friday said Donald Trump’s temporary ban on Muslim travel into the U.S. would not survive Constitutional scrutiny.

“If I had to pick a particular position that would concern me the most, it would be the ban on Muslims,” Cole, a lawmaker close to GOP leadership, said Friday on MSNBC. "I think it’s clearly, you know, unconstitutional, it’s ill-advised, it would really hurt the U.S.

“We need a lot of Muslim friends to deal with what we’re dealing with overseas, and we have some great Muslim friends. And we ought to recognize that and be sensitive.”

What he actually said was a “temporary ban” on Muslims entering the country (not Muslim American citizens) until we can figure out who they are, etc. That IS a timeout but the liberal media ran with it to make it sound like he would completely and permanently ban all Muslims. That’s not what he said.

And I’m not an idiot. I understand exactly what he said and meant.

How could a GOP representative be so breathtakingly ignorant about the Constitution and US law?

Donald Trump's proposed temporary measure is eminently Constitutional, and indeed Jimmy Carter used such explicitly defined Presidential powers to prevent Iranians from entering the US during the hostage crisis.

Under US federal law, the President has arbitrary authority to deny foreign nationals entry into this country, based on any criteria he or she sees fit. Period. End of sentence.

There isn't even the remotest Constitutional issue with Trump's notion. So if this poltroon/GOP representative (but I repeat myself) believes such lies, he needs to either "back it" up or "STF" up...

Vote Trump!

If I am not mistaken, there is a law on the books that allows the President, for reasons of national security, to block any specific group from entering the country -- whether as tourists, immigrants or refugees.

Is Rep. Cole aware of this law? And does he judge it unconstitutional, too?

No foreigner has a constitutional right to enter the country and the US government is perfectly free to discriminate in admissions to the country in any manner it sees fit.
