The Obama administration will send a letter to every public school district in the country Friday warning them that they must allow students to use whatever bathroom and locker room corresponds to their stated gender identity, or face a federal lawsuit.
The decree, sent jointly by the Department of Justice and the Department of Education, comes just a few days after North Carolina and the federal government sued each other over the states recent law governing bathroom use in public buildings. It wont be a new federal law, but will instead reflect the Obama administrations interpretation of existing federal anti-discrimination law.
In particular, the decree is based on Title IX, the 1972 law prohibiting sex discrimination in schools that receive federal funding. While the drafters of the law may not have known it at the time, the Obama administrations position is that the law covers discrimination based on gender identity as well as physical sex.
A school may not require transgender students to use facilities inconsistent with their gender identity or to use individual-user facilities when other students are not required to do so, the letter says, according to The New York Times, which obtained a copy.
Currently, federal courts have not conclusively settled whether, and to what degree, sex discrimination laws cover matters of gender identity as opposed to physical sex. But the Obama administration appears optimistic that an aggressive approach will succeed, especially after an April court ruling favored a transgender Virginia girls who sued for the right to use a boys bathroom.
The letter says that schools must immediately respect a students new gender identity as soon as it is declared by their parent or guardian. Schools are not allowed to require that a student provide a medical diagnosis to justify the change, and they also cannot require a student to legally change their gender.
To assist schools in implementing the new policy and help those made uncomfortable by it, the letter includes a 25-page document of emerging practices, with suggestions such as erecting privacy curtains in locker rooms for those who need extra privacy.
Obamas new order will without a doubt enrage many Republicans who have argued that transgender bathroom policies will allow perverted men to prey upon women in bathrooms and locker rooms. A few such incidents have already occurred.
In February, for instance, a Seattle man used the citys now transgender bathroom ordinance to enter a womens locker room and begin stripping while young girls were using it. When confronted, he said the law gave him the right to be there, and he was never identified or arrested.

Rhetoric tends to evolve over the course of controversies like this, so I reserve the right to revise the conversational loop as we go along. But at this point, I find "do you really think teenage girls should be forced to shower with the boys" to be a winner. The other side simply doesn't respond. They want to talk about bathroom stalls. They don't want to talk about 16 year old girls being forced to shower with mentally ill boys. And they don't want to talk about boys on the girls' athletic teams.

Now this open lawlessless in public schools should be the last straw. The dream of every 12 year old boy is get in the girls bathroom and sneak peak. Well now they can not only sneak a peak they can bring their video camera in with them and make movies and then take a shower with the little girls.
Obama has gone stark raving crazy. All parents that love their children will not expose them to anything this dangerous. I’ll go further. Obama should be impeached and kicked out of office for putting the nations children in danger. He’s a damn madman. No sane grown-up can agree with letting little boys and girls use the same bathroom and take showers together.
The only thing that needs to kept in mind is that the President cannot legislate. It is perfectly legal and proper to ignore any decree.
This president seems to think he can rule by decree.
It is up to every citizen to show him some reality.
Since when did the presidency become the office for a man who has absolute control over our lives and can demand we do anything he wants?

First, if the states are already accepting funds for agreed-upon purposes, it is coercive and unconstitutional to withdraw all the funding by adding new provisions.
Second, it is Congress, and not the President, who sets the purposes of the funding. Obama cannot add new spending requirements on his own and then withhold the funding for non-compliance.
So the SCOTUS ruling on the Medicare expansion of Obamacare should be precedent to stop Obama from using federal funding supplements to schools to coerce them into accepting new bathroom political policies.

It’s an arguable point, bit it will never get to that.
School districts will ignore it on-mass. Some will shrink before it, but those will be the Dem-Lib areas, and that will only PO the middle of the road voters there.
Obama has given Conservative America a Godsend in this mandate. It is the first “good thing” he has done for Conservatives in 8 years.
In MOR states, he has given us a huge wedge issue in the general election.
Can you imagine asking a MOR swing voter: “You say there is no difference between Rs and Ds???? They want to let 9th grade perverts take pictures of naked little girls in their PE shower and post them on the internet. We don’t. Is that enough of a difference for you?”
This will move 80 electoral votes and 30 House seats in November.
Rhetoric will only lead to acceptance. The parents need to band together, figure out a plan, and pull their children from the public schools.
Actions speak louder than words. Yes, I understand the tax issue and have a similar solution that would be effective if chosen to do en mass.
