HUD Wants to Make Living in a Tiny House or RV Illegal

The tiny house movement has taken America by storm, in part because our economy is in the toilet. People are striving to reduce their expenses by embracing minimalism. They’re breaking free from the corporate grind because, as I’ve always advised, they are learning to live with less and radically reducing their expenses.

But, these days in America, you are sharply admonished when you try to live your life outside of the strictures of the 9-5 world. Is it any surprise that the government is now taking steps to limit our ability to drastically reduce our expenses? They always seem to make illegal anything we try to do to be more independent and moving into a tiny house appears to be the next on their list.

HUD has proposed the following law:

This proposed rule would modify the current exemption for recreational vehicles in the Manufactured Home Procedural and Enforcement Regulations.  Under the current exemption, questions have arisen regarding whether park model recreational vehicles are regulated by HUD’s manufactured home program. These park models are being produced with patio roofs, screened in porches, and other extensions that exceed the 400 square foot maximum exemption in the current regulations. Additionally, some of these models are being marketed as suitable for year round living. HUD’s proposed rule would permit recreational vehicle manufactures to certify that a unit is exempted from HUD’s regulations. Specifically, HUD’s proposed rule would define a recreational vehicle as a factory build vehicular structure, not certified as a manufactured home, designed only for recreational use and not as a primary residence or for permanent occupancy, and built and certified in accordance with either the National Fire Protection Association (NFPA) 1192-2015, Standard for Recreational Vehicles, or the American National Standards Institute (ANSI) A119.5-15, Recreational Park Trailer Standard. In addition, to provide consumers notice regarding the manufacturing standards used to construct the unit, HUD’s rule would require that units claiming the exemption display a notice that identifies the standards used to construct the unit and states that the unit is designed only for recreational use, and not as a primary residence or permanent dwelling.

That’s right – if this law is passed, these structures will be classified as “not suitable for a primary residence or permanent dwelling” in April of this year.

While currently they’re only talking about a label, how long will it be before the long arm of the law reaches out to punish those living full time in homes that are deemed “not suitable for a primary residence or permanent dwelling”?  My bet is, not long at all. This may be the first step toward making it illegal to live in a tiny home or an RV.

Some of those tiny houses are quite beautiful and appear to me to be eminently livable but you are right, many of those houses would be a nightmare to live in full time!

I’ve seen two episodes of the Tiny Home reality show and got claustrophobic just watching. Then when the “little woman” was doing the laundry outside in something like a coffee can, I figured these people are completely insane.

It's about establishing yourself as a legal resident of a state with no income tax, without having to actually rent or own a residence there.

There are many people who have one or two perfect children with whom they spend very little time. Most schools have before and after school child care, add in youth activities and home is for sleeping and bathing, not much else.

I know I’m in the minority, but I firmly believe that the hand that rocks the cradle rules the world. A tiny house doesn’t allow younger couples to be fruitful and multiply; influencing the culture more and more with every generation.

Our older, large home in a small town cost less than many of those tiny homes, it just isn’t as perfect and beautiful. However, it holds many precious people and there’s always room for company, including visiting relatives and missionaries.

A tiny home allows just enough space for a few people to live for themselves.

This must seem especially attractive to childless young people (who don’t have to worry about uprooting children and moving them from school to school); it also works for people that don’t want to watch their neighborhood change for the worse when they still have 20 years left on a mortgage.

The article headline is misleading

For HUD to loan on manufactured housing it has to be built to HUD Code and tagged with metal plate certifying the same.

Park Homes do not qualify as “manufactured homes” for FHA lending because they are not built to HUD manufactured home code.

And a lot of Park Homes do not meet the HUD minimum size requirement of 400 square feet, but that is a moot point anyway.

In my area HUD seems to be involved in “re-whitening” deteriorating areas; people with good incomes can buy cheap homes, but have live there for 5 years. Reminds me of the homestead laws where settlers owned the land after working it for five years...

The regulations need to return to their original spans of control.

RV regulations were for Recreational Vehicles. The intent for the ANSI standard was to provide standardized dimensions for locations of utility hookups and the RV Structure, so they were not pinned into more formal permanent housing codes, but still would allow an RV to pull into a trailer park anywhere in the nation and make familiar utility hookups.

It was recognized that some mobile home parks allowed Park Model RVs for smaller dimensions. The Park Model allowed the tenant to use normal residential furnishings and utilities. In a Park Model, you have a large enough doorway to install a regular toilet, regular washer/dryer and a residential bed, ...even a king size bed.

It still was a trailer and had some accoutrements found in the residential market.

A real problem arises with legalists who want to control everybody else into their model and empire constructs in their own thinking without respecting the property and limited rights of others.
