- Lexi, a six-year-old with one-and-a-half per cent Choctaw Native American blood, is about to be ripped away from the only home she's ever known
- Summer and Rusty Page, Lexi's foster parents, are not Native American
- Due to the 'Indian Child Welfare Act', Lexi can only live with other Native American families
- Summer and Rusty from Santa Clara, California, have been fighting for two years to adopt the child
- Now a court ordered emergency stay has been lifted, the Department of Children and Family Services will try to remove Lexi any day
- The Choctaw Tribe has decided to place Lexi with a person in Utah who is not Native American and does not live on a reservation

Some of these Child Protective Custody People are simply tyrants.
The child has been with these people for five years. they live her. They are the only parents she knows...and they want to adopt her.
but the little PC correct tyrants will rip her away form that and send her to people unknown over such a trifling ridiculous rule.
1.5% Choctaw means essentially that she is not Choctaw.

I know a couple who adopted a girl whose mother was a “first nation” in Canada. The biological father, as far as they know, was white
The girl, who was in her teens, made a point to travel 500 miles away to the United States, to get away from similar laws in Canada, which would have involved the Canadian Government and its asinine first-nations laws in the birth of her child.

From what I read, the Choctaw Nation doesn’t have a blood quantum rule, but in order to join the tribe, the person must be able to document descent from original enrollees of the tribal rolls.
One and one-half percent is so small as to be meaningless.

Agreed. Native American ancestry is not uncommon, especially if you had any ancestors living on the frontier before about 1838. 1.5% translates to 1 such ancestor 7 generations back. Frontier men often sought out Native American women because of the shortage of pioneer women. Certain tribes, especially the Cherokee, sought out such marriages for their daughters as a means of gaining tribal stability with blood relations.
That system, of course, was destroyed with the 1838 "Trail of Tears" expulsion but tribes further west carried it on even as late as the 1870s, including a branch of my own bloodline. A young white being an honored member of the Siouxian tribes in particular would often make the difference between being passed over of massacred when the cavalry was on the rampage.

Back in the eighties or early nineties there was a case of a 8 or 10 year old adopted child who was removed to the tribes after a private at birth adoption.
This is the fact of life of adoption.
It is morally reprehensible but legal.
