A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruzs ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruzs mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruzs place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.

You have to use the meaning at the time, not todays liberal interpretations...that's how you get a "living" constitution.
Natural born means two US citizen parents giving birth to their child on US soil.
I was born in Germany, to two US citizen parents, my father was in the military.. I am NOT a ‘natural born’ US citizen... I have NO born in the USA birth certificate .
Can a court or Congress declare a child ‘firstborn’... Well, no court can bequeath ‘natural born’ US citizenship. Only two US citizen parents giving birth to their child on US soil.
Title is misleading. There is little doubt he is an American, BUT You can be a citizen, and not a NATURAL BORN Citizen (a phrase only used in the Constitution regarding POTUS). My father was an American Citizen, but not natural born - he was German born. Same with my stepfather, step uncle, aunts, uncles, cousins etc. All Americans, but not were natural born citizens.
Frankly, I don’t care one way or the other, that isn’t why I refuse to support Cruz. But it is important that a distinction is made because the distinction is in the wording of the Constitution.

The title and argument is a fraud. The issue is not whether or not Ted Cruz is a U.S. citizen. The issue is the fact Ted Cruz is a naturalized U.S. citizen due to his birth abroad and acquisition of U.S. citizenship by the authority of a naturalization law, the U.S. Immigration and Naturalization Act of 1952. The people writing this stuff are trying to mislead and deceive readers with a fake and strawman argument.
Well, he probably is...if his mom didn't screw up and fail to do his paperwork.
That statement will be true only if a court decision says so, probably an opinion by the Supreme Court. No such opinion is extant, even though several of the birther tomes claim something else. Until a court overturns INA, Sections 301 and 309, are the law of the land and will apply. They are both natural born citizens.
Assertions otherwise written in all caps, draped in Vattel, and quoted by the tooth fairy will not change the current facts and law.

It depends. Were they born on US soil (military base)?
My cousin was born on base in Germany, his dad, my great uncle, was married to a German woman, they lived on base and he was born on base and given an US Birth Certificate.
Born off base, not married? (as in the case of another friend of the family) No US Birth Certificate and had to become naturalized (came over with his mother and US Citizen Father after the War).

That is a false argument and a fraud on the readers. The Congress is a legislative body that creates manmade laws. The Congress has no power to create natural laws or natural born citizens. The Congress does have the power to confer artificial citizenship upon a foreign born person using naturalization law, but the Congress has no more power to confer natural born citizenship on a child than they have the ability to confer natural birth on an adoptive mother. A natural mother is natural by the law of Nature. An adoptive mother is a mother by the statutory law of man passed by state legislatures and/or by Congress.

Are you saying that South Dakota issued a birth certificate to a child born in Germany? Have you actually seen this ‘birth certificate’ from the State of South Dakota?
Well supposedly we do, at least one that was published, but was it ‘fake’ which IMHO it is, but there is one out there from Kenya...so you decide...I found them, looked at them and personally, I would choose the one from Kenya because it looks more real...

Yes and Yes. The cousin is close to my age and we grew up together. Because the child was born (and it was verified) on a US military base to a US Citizen and his legal wife. It happens.
Nope. Worked with a gal in 2004 who had dual Canadian America citizenship.
