If we lose the Senate, then Obama will have a chance. Correct me if I am wrong, but the new Senate is sworn in Jan 3, but the new Pres isn’t sworn in until Jan 20th. So..... if the Dems get 51 senators in 2016, then there will be 17 days when O will have a Dem Senate while he is Pres. Watch the 60 vote rule evaporate for this “emergency”, only to re-appear when a Rep is in the WH.

Since this year is soap opera bizarre world, anything is possible. Could your scenario happen if the US Senate doesn't take a recess? Not that I can imagine those fools staying in session until the inauguration.

Another not impossible situation is that there are a dozen or so Republican US Senators who are absolute enemies to conservatives. After the election, with lame ducks and people those who will do anything to punish Constitutional Conservatives, would those 'pubs out of spite vote for the Obama choice?
