( Vanity ) If Ted Cruz is the Republican nominee

've never started a thread (in 16 years), but I have a question for discussion.

Assume Ted Cruz is the Republican nominee. The Democrat candidate files lawsuits challenging Cruz's Natural Born Citizen status in two or more appellate districts. In one, the Court of Appeals rules that Cruz is a Natural Born Citizen and must appear on ballots. In another, the Court of Appeals rules that Cruz is not a Natural Born Citizen and cannot appear on ballots in that district.

Both cases are appealed to SCOTUS, but no replacement for Justice Scalia is nominated and confirmed. In both cases the Supreme Court splits 4-4. Would the matter revert to the decision of the Appeals Court so Cruz would be on the ballot in some states but not others.

To complicate the matter further, some states, California for example, span two appellate districts. If the decisions conflicted, Cruz would appear on some ballots in a state but not others.

What happens now?

Well, why isn’t he a natural born citizen of Cuba as well, he’s got the one Cuban parent.

I don’t think Cruz is a NBC of this country but it seems like some people disagree - I just hope they keep disagreeing if he somehow become the nominee. I’d vote for the Canadian/American/Cuban in heartbeat against Hilltard.

Yes, born of American Citizens that were citizens before the birth of the child. That’s the way I always understood it.

Our laws are based on English laws in every state but Louisiana, which is based on Napoleonic law. The British considered any children born to an English citizen to be a British subject no matter where they were born, and even if only one of the parents was an English subject. Our founding fathers held similar views, and they would have considered Cruz as a natural born citizen since his mother was an American natural born citizen.

Sorry but you are incorrect. Canadian law at the time required several years of residence in order to become a citizen. It was not legally POSSIBLE for Sen Cruz's mother to be a citizen of Canada. Even if she changed her citizenship later, at the time of Sen Cruz's birth, she was a US citizen.

A citizen at birth is a natural born citizen and has never needed to be naturalized.


You are so wrong. The very fact that application must be made to our consulate in a foreign country to receive a certificate requiring approval by said consul is not a natural act. A natural act is being born in an American hospital where a birth certificate is ROUTINELY issued and no proof is required other than the signature of the attending physician attesting to the actual birth. That is natural! Doing paperwork is not.

In any event, how is it possible to be a natural born citizen in TWO countries simultaneously? Cruz renounced his Canadian citizenship a few years ago.....so was it then that he became a natural born citizen? That last question was sarcasm. What a perfect world we would live in if only people engaged their brain before speaking. Golly, a natural born citizen of two countries!

And what did I site as my sources in supporting my position? The relevant sections of the US Constitution and U.S Code.

Because we've been trough 100 time before on FR and I have no intention of arguing the same thing over and over. Seriously, under the definition your arguing osama bin lauden's child could be POTUS if born and raised in Pakistan provided his mother had duel citizenship of Pakistan and America.

If you want to follow the legal trail instead of just other’s opinions, take a look at post #63.

BTW, no other nation’s laws determine who the US considers it’s citizens. During and I am sure for some time after the American Revolution, England likely laid claim to those born in America.

If Brazil claimed all those born with the last name of Cruz, so what. It is not US law and has no weight. Cuba can claim anything they want.

If Bin Laden’s child met the legal requirements for US citizenship AT BIRTH, then yes, they would qualify as NBC. We are a nation of LAWS. If you don’t like the laws - fine. Elect those that will change them.

Trump is a defendant in a huge RICO lawsuit that is going to trial in July or August; and based on the facts, he is going to lose BIG. How in the world can he be running for President while he in trial and the Democrats calling him (truthfully) a racketeer?
