I’m no longer tracking it. Looks settled.

He might win in court, very likely. But too many originalist interpretations would define him as ineligible. Will never be a slam-dunk answer to vindicate Cruz.

Even current case law, August 2015, would have Cruz naturalized.

Those that include one born in another country to a non-citizen parent as a NBC, reduce NBC to the lowest possible form of citizenship; a form that requires governmental acknowledgment to even exist.

One can argue the language the founders used when they created the position of Commander-in-Chief doesn't require an "originalist interpretation" at all. Out of the entire government scheme, they required NBC for this office alone. Because the founders were giving the CiC of the nation's armed services unlimited power and authority over the nation, they intended he not be subject to the influence of any other country through birth or parentage.

Those who argue that is not what the founder's intended have the burden of proving otherwise.
