Trump: 'I'd Do The Public A Big Favor' By Suing Ted Cruz Over Eligibility To Be President
Daily Caller ^ | 1/17/16 | Steve Guest

Posted on 01/17/2016 12:48:44 PM PST by jimbo123

Donald Trump unloaded on Sen. Ted Cruz, saying, "I'd do the public a big favor" by suing Cruz over his eligibility to be president.

-snip-

Stephanopoulos then said, "But you know, the person who sued him probably doesn't have standing, a lot of legal scholars-." Trump interrupted, saying, "That's all right. There will be a lot of people who sue him who do have standing."

"Say you have standing, why don't you file the case," Stephanopoulos asked. Trump responded, "Oh that's an interesting case. Wow that sounds like a very good case. I'd do the public a big favor."

-snip-

Stephanopoulos then asked Trump if he was going to put his money where his mouth is, and Trump said, "Well it's a good idea. Maybe I'll talk to them about it. I'd like to talk to Ted about it, see how he'd feel about it. Cause you know, when I file suits, I file real suits okay."

What else do you need to know?

Let's start with abortion.

In 1999, Trump said that he would not ban even partial birth abortions because he was, in his own words, "pro-choice in every respect."

Sure, that was over 15 ago. Hopefully, he has changed. Some people do. Norma McCorvey a/k/a Roe from Roe v. Wade became a pro-life activist.

Has Trump ever said that he was wrong in 1999 and that he is now pro-life?

“I don’t think he has the right temperament,” Trump said. “I don’t think he’s got the right judgment. You look at the way he’s dealt with the Senate where he goes in there, frankly, you know, like a little bit of a maniac. You’re never going to get things done that way.”

“I have gotten to know him over the last three or four days, he has a wonderful temperament. He’s just fine. Don’t worry about it,” Trump responded.

“Look, the truth is, he’s a nasty guy. He was so nice to me. I mean, I knew it. I was watching. I kept saying, ‘Come on Ted. Let’s go, okay.’ But he’s a nasty guy. Nobody likes him. Nobody in Congress likes him. Nobody likes him anywhere once they get to know him. He’s a very –- he’s got an edge that’s not good. You can’t make deals with people like that and it’s not a good thing. It’s not a good thing for the country. Very nasty guy.”

Wow. Very disappointing that everyone is throwing Cruz under the bus. I guess ‘we need to get along’ and NEVER shut down government and spend what ever the Dems and Nancy Pelosi wants to infinity.

Many Freepers are destroying Cruz. And after being here for ~20 years, these same Freepers will be the ones to grouse that Ryan/Trump/Pelosi/McConnell are ‘spending too much money’.

Sure I will vote Trump over Hillary or Sanders. But he is already talking about a ‘program’ for ‘student loans’ and we need to ‘trust him’.

Very demoralized we are fighting over how fast to destroy Cruz.

Once Trump has his primary opponents destroyed, I expect him tack HARD left on Kelo, Affirmative Action, Taxes and even some social issues.

Isn’t it about time we take some responsibility for this? We were docile, letting the political elite class push aside the rule of law for the rule of man... surely we can admit the mistake and make sure it doesn’t happen again.

“There is precedent on what to call a person (citizen-at-birth, no Naturalization Certificate) born abroad to a citizen mother and alien father. Mr. Bellei was naturalized US citizen. So is Cruz.
You want to bet money SCOTUS will reverse about 200 years of rock-solid consistent precedent to rescue Cruz? Or are you planning to fool the public and hope SCOTUS never takes it up, once the people have spoken? “

I have no idea the outcome. I only state the fact it is unsettled, for the benefit of those who claim otherwise.

There are claims on both sides. None conclusive.

When I was in school decades back, the teaching was born on US soil, unless overseas as a diplomat.

By that criteria George Romney did not qualify, but dropped out before it became an issue.

The Senate dealt with McCain in effect deciding his Panamanian birth was like a diplomat situation.

Cruz’ parents clearly were not diplomats or military.

If Trump continues his lead, it will probably not be pursued further with Cruz.

'I'd Do The Public A Big Favor' By Suing Ted Cruz Over Eligibility To Be President

Bring it on, idiot. Even the rest of the Democrats aren't that stupid.

" Cruz should have never let things get this far. "

Ted needs The Donald to sue him to get this off the board.

Ted, being the worlds smartest lawyer, proves his NBC theory, everything gets defined, what could be better?

So this is what Alan Grayson would be like if he were a billionaire? Yikes!

If we wait until Grayson can get a judge to take out the only guy standing in the way of the dem candidate, Ted isn’t going to get a fair shake; it’ll be too tempting for the party of the “Magnificent Eight” to corrupt the judge. The only time Ted - and the country - will get a fair shake is if the case is decided when Trump will be the nominee if Ted is taken out. The dems hate them both, so they don’t gain anything by having a judge take out Ted if it just means Trump will be the candidate.

That’s why this needs to be done now.

Try not to be disheartened by the game of checkers in front of your eyes; there’s a game of chess being played underneath it all, and Cruz and Trump may both be smart and patriotic enough to work together behind the scenes to protect this nation. They’re both good guys and I think they both know it, in spite of the public show they have to put on.

What a rancorous competitor. A great way to make America great, no doubt.

There is precedent on what to call a person (citizen-at-birth, no Naturalization Certificate) born abroad to a citizen mother and alien father. Mr. Bellei was naturalized US citizen. So is Cruz.
I looked it up and the Supreme Court definitely seems to directly disagree with the recent position paper by certain Harvard Law Review hacks. In Rogers v. Bellei (1971), the SCOTUS found the following:

"Every person born in the United States, and subject to the jurisdiction thereof becomes at once a citizen of the United States, and needs no naturalization. A person born out of the jurisdiction of the United States can only become a citizen by being naturalized, either by treaty, as in the case of the annexation of foreign territory; or by authority of Congress, exercised either by declaring certain classes of persons to be citizens, as in the enactments conferring citizenship upon foreign-born children of citizens," (emphasis mine).

I'm not a lawyer, but this sure seems to support Trump's case against Cruz, but maybe I am misunderstanding this SCOTUS decision. (I don't think this is just orbiter dicta.)

" We deserve to know and it really isn't a conservative or liberal problem. It is an American problem. "

Exactly!

Unpopular with the Good-old-boys Club of the Senate? That’s a huge plus in my book. I can’t even come up with five Senators that I like. The vast majority of GOP Senators have sold us out for the last five years. Ted Cruz stood against them.

To be fair to the others, consider that they believe that Cruz is a naturalized citizen. This is not a kook position, it is really settled law. They like the guy, but that's an insurmountable obstacle if Congress, or the GOP, or SCOTUS, or enough people in the press suddenly figure out the fact of the matter.

Most of the public has bought into a lie. Not the first time that's happened.

The objection isn't based on aversion to his policies. He is admired, except for this qualification issue.

Cruz doesn't have to prove he is eligible. The burden of proof fall on the one who files a complaint and Trump knows that there is no there there. As for the "New-York" values thing, it really resonates with middle America in that Trump is on record confirming this. Bref, Cruz is setting him up to trip up and Trump is walking right into it. You and I know what "New York values" are and so does the rest of America. Trump is good and I would support him but temperment is what is being measured here and Cruz's got his number. IMHO.

Cheers!

RNC wouldn’t have standing until after it’s too late, if I’m understanding correctly.

I think the only one who can do it is Trump. He needs to do it.
