Ted Cruz is not eligible to become president

Republican presidential candidate Ted Cruz was born in Canada; he is not a "natural born citizen," and he is not eligible to be president.

And this is an issue that isn't going away, contrary to The Sacramento Bee's assertion, ("Trump's 'birther' lunacy, the sequel," Editorials, Jan. 7)

The Constitution is very precise: "No person except a natural born citizen ... shall be eligible to the office of President." The founders knew what they meant.

John Jay, later the first chief justice of the United States, wrote: "the commander in chief of the American army shall not be given to, nor devolve on, any but a natural born citizen." Later, one of the authors of the 14th Amendment, Rep. John Bingham of Ohio, wrote: "Who are natural born citizens but those born within the Republic?"

Congress has passed a statute that says if one of your parents is a U.S. citizen, you are an American citizen, too, no matter where you were born. Cruz's mother was born in Delaware. That makes him a "citizen" by statute, but not a "natural born citizen" within the meaning of the Constitution.

If both of Cruz's parents had been American-born, Cruz would have a stronger case. However, his father was born in Cuba.

Every other president and presidential candidate in our history was born either within the United States or one of its possessions. At no time ever was Calgary, Canada, where Cruz was born in 1970, a U.S. possession.

"Naturalization" is a legal action that can occur with no "procedure." Naturalization is making a non-citizen into a citizen, by an Act of Congress. It doe not require application, delay, test, renunciation of foreign allegiance, and oath. But Cruz would have you believe that if that "application ... oath" process isn't undertaken, then the non-citizen hasn't been converted to a citizen.

There is a section of US Code that naturalizes people without the person having to apply for it. 8 U.S. Code Subchapter III, Part I. A separate part, Part II, has all the "application ... oath" stuff. Both parts are naturalization.

People either love him or hate him, there’s little in between. But... I just had a conversation with an soon-to-be-laid-off Alcoa employee and he’s made up his mind to hold his nose and vote for a future. His choice? Trump.

Of course he's not: No constitutional conservative is "eligible". If it wasn't the birth thing, they'd find some other specious technicality on which to knock him out.

I don’t think that there is any law that says that someone who is ineligible can’t run for the nomination of a party.

I further don’t think that there is any law that says someone who is ineligible can’t run for president.

“No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;”

It only seems to suggest that one’s eligibility is tested at the time one tries to take office, and that occurs after one is elected.

Accepting that Cruz is a NBC, it will be up to the voters to decide if it matters that Cruz:
1. Remained a dual citizen until shortly before announcing
2. Did not renounce Canadian citizenship at 18.
3. Served in the Senate as a dual citizen

A nitpick correction, it takes on from the House plus one from the Senate, IIRC. Somewhere in 3 USC, we'd find the right answer.

I think there are other formal ways to get a ruling, but that depends on the candidate being open to a decision on the merits. But nevermind that, I'll take your position for sake of argument. If there is enough doubt, the candidate loses the election anyway, no formal decision is needed. I think Cruz is toast. He gave it a good shot. It was a gamble.

Obama born on U.S. soil. Cruz not. However, I have not been a birther, but on current reflection could Obama not be natural born because his father was not a U.S. citizen?

Now can’t anyone have standing to challenge Obama’ eligiblity. Everyone has been harmed by his presidency.☺

I think I've figured it out.

The only ones with a fleeting appreciation for what we once had in America are those from abroad.

Those here for ages have grown so fat and insecure that we no longer care. We are ripe for destruction.

America is finished and, frankly, has been for a long time.

From what I read regarding the 1790 statue you can be born on foreign soil but both parents need to be U.S. citizens. That is the rub.
