Ted Cruz is not eligible to become president

Republican presidential candidate Ted Cruz was born in Canada; he is not a "natural born citizen," and he is not eligible to be president.

And this is an issue that isn't going away, contrary to The Sacramento Bee's assertion, ("Trump's 'birther' lunacy, the sequel," Editorials, Jan. 7)

The Constitution is very precise: "No person except a natural born citizen ... shall be eligible to the office of President." The founders knew what they meant.

John Jay, later the first chief justice of the United States, wrote: "the commander in chief of the American army shall not be given to, nor devolve on, any but a natural born citizen." Later, one of the authors of the 14th Amendment, Rep. John Bingham of Ohio, wrote: "Who are natural born citizens but those born within the Republic?"

Congress has passed a statute that says if one of your parents is a U.S. citizen, you are an American citizen, too, no matter where you were born. Cruz's mother was born in Delaware. That makes him a "citizen" by statute, but not a "natural born citizen" within the meaning of the Constitution.

If both of Cruz's parents had been American-born, Cruz would have a stronger case. However, his father was born in Cuba.

Every other president and presidential candidate in our history was born either within the United States or one of its possessions. At no time ever was Calgary, Canada, where Cruz was born in 1970, a U.S. possession.

A state Secretary of State could disqualify him. He'd then sue, getting a definitive court ruling quickly.
May even be taken up by the Supreme Court.

After much thought, I agree. Ted Cruz was born an alien, in another country. He received citizenship through Congress, by law not birth. The law states he is a citizen, not a natural born citizen.

Flame away.

I read somewhere that Cruz didn’t get his US citizenship until he was 15 months old. (haven’t seen more than one source, so can’t be sure it’s true) Can’t figure out how that’s a natural born citizen.

Well, there is doubt.

And Cruz has only used his own words to assuage that doubt.

Action speaks louder than words.

As an aside, the way Trump dispatches opponents is to pick at them until they reveal who they are...their personalities.

Cruz is a very smart guy...but no one seems to like him. He has lots of supporters, but his classmates at Princeton and Harvard didn't like him.

His fellow Senators don't like him.

He is certainly brilliant and a great debater.

Furthermore, it isn't necessary that a good President be a likeable person.

That said...folks just don't vote for an unlikeable person for President.

Cruz is smart as a whip...but he just isn't likeable.

He's too smart for his own good. And just doesn't know how to reign it in.

In his emails to the Guardian, Tribe discussed Cruz’s own approach to constitutional issues, noting that under “the kind of judge Cruz says he admires and would appoint to the supreme court - an ‘originalist’ who claims to be bound by the historical meaning of the constitution’s terms at the time of their adoption - Cruz wouldn’t be eligible because the legal principles that prevailed in the 1780s and 90s required that someone be born on US soil to be a “natural born citizen.”

He added: “Even having two US parents wouldn’t suffice for a genuine originalist. And having just an American mother, as Cruz did, would clearly have been insufficient at a time that made patrilineal descent decisive.

“On the other hand, to the kind of judge that I admire and Cruz abhors - a ‘living constitutionalist’ who believes that the constitution’s meaning evolves with the needs of the time - Cruz would ironically be eligible because it no longer makes sense to be bound by so narrow and strict a definition.”

Tribe said: “There is no single, settled answer. And our supreme court has never addressed the issue.”

I'm sorry, but the person writing this has not reviewed the law. Natural Born Citizen is well defined by U.S. statute. It is not the same as native born, but often confused by the uninformed.

Cruz is totally qualified as a Natural Born Citizen (which means a "citizen at the moment of birth") by his mother's citizenship.

This is simply the TRumpettes trying to muddy the water.

Bozo Perot split the Republican vote in 1992, which gave us Clinton. Had Bill not been elected, we would never be faced with Hillary.

Why are Conservatives so intent on eating their young?

He was a citizen at birth, did not need to go through a naturalization process, he’s a natural born citizen

“Born in the USA” is not the issue. “Natural born citizen” does not mean born in CONUS, (”native born”) but rather “a citizen at the moment of birth,” which Cruz is by his mother’s citizenship.

It’s been clear to me for at least a year that Cruz is technically not eligible to be president. That being said, it didn’t stop Obama from being president.

I am a Ted Cruz supporter and I agree that he is not constitutionally qualified for President, because he is not a Natural Born Citizen.

I further believe that, after 8 years of the similarly unqualified Obama, it does not matter.

By the way, the only body that can disqualify a person who has received the requisite number of Electoral votes is the U. S. Congress assembled to count those electoral votes, and that requires only one Congressman to object.

Also, the USSC has no voice in the matter whatsoever, unless the Congress gives them that voice through legislation.
