Former House Majority Leader Tom DeLay told Newsmax TV on Wednesday that Ted Cruz might ultimately "end up in the courts" on the question of his citizenship and how it might affect his presidential campaign. "I've had this problem ever since Cruz announced," DeLay, the five-term Texas Republican who served from 2003 to 2005, told "The Steve Malzberg Show" in an interview.
"There is a difference between the definition of natural born and naturalization â and it has not been settled by any branch of government. "Cruz needs to address this in some way because it is a cloud right now in Iowa," DeLay said. [...]
DeLay, however, told Malzberg that the "most expedient" way for Cruz to settle any questions is to work through the courts. "You can't do anything through Congress," he said. "Congress isn't going to pass any bill to protect him â and I'm sure [President Barack] Obama wouldnât sign anything. "He's going to the courts if he's the nominee. The Democrats will use every avenue available to them.
"They sued me over a valid issue," DeLay said, referring to a 2006 lawsuit brought by Democrats after he dropped his re-election bid. "They'll sue him. "He'll end up in the courts one way or another."

It really is that simple. Natural born citizenship is an unquestionable one because there are no others to choose.
Trump they fear more because he is flouting them in their weakness. Cruz is blessed, but is he blessed to the specific post of president, we can’t read God’s mind here yet. He could stand in the political gap in a number of capacities, even remaining a Senator.
People keep thinking a suit has to be filed at the national level.
It can be filed as a suit simply to deny ballot access at a state level.
How many states before that makes a difference? Depending on the state, of course, it could be just one state would make a difference.

After reading this article over repeatedly it seems the source for information in the article is someone within the Texas Republican Party Cruz has some enemies there.

The difference of opinion on this subject is totally independent of other nations' laws.
One camp says the fact that Cruz's citizenship depends on a US statute makes him not an NBC.
The other camp says that if a US statute confers citizenship at birth, regardless of the conditions of the grant, that person is an NBC.
Assuming some other country makes a claim on a person not under their jurisdiction (which probably would never happen, but who knows, maybe some make the claim now), that claim is irrelevant. The question has to do with the conferring of citizenship by the constitution alone (which does confer citizenship without resort to statutes), vs the power of congress to name anybody in the world as a NBC of the US. Congress certainly has the power to compose a statute that says a person born in some other country is a citizen of the US at birth.
Ever notice how A dozen or so Trumpophiles on this forum never post anything positive about their candiate with the exception of favorable polls.
They rather bottom feed the internet for any (generally) bogus manure they can throw at the one bonafide conservative in the race.
Remind you of the modus operandi of any group in particular? They have nothing positive to post on their man because it doesn’t exist. Trump is a documented liberal who has been on the wrong side of damn near every issue concerning conservatives over the past 20 years.
Rather than try and prove their candidates conservative bonafides (which is impossible)they seek to destroy the image of the opposition. They learn from the best as Trump is a master at it.
Trump has a couple of good ideas and he takes no crap from the press. That’s good, but the mountain of baggage that he carries with him vastly outweighs the few positives in his political resume.

You are correct, and you can bet as many opinions as there are here, there are that many opinions in the courts of this country.
It seems undeniable that he would be tossed from at least one state. Hopefully, not too close to the election, but you know the havoc it would cause.
Fair enough, in 2012, while running for senate, it wouldn’t have mattered, so I misspoke there.
However, DeLay says he had trouble with this “since Cruz announce” for President. That was March last year, 10 months ago, but now he weighs in?
I liked DeLay once, but he became another Washington establishment guy, in the end.
BTW, I live in the district he represented, now represented by Pete Olson, who did vote for the stimulus package, which I am not happy about.

Good grief, when are people going to figure out that "natural born" has a very specific meaning that is found within English common law. If your citizenship is established by a statute made by Congress (as Cruz's ias), you are *by definition* a "naturalised" citizen. That's not the same as "natural born."
Being the lawyer that he was, I really don’t think Cruz would have started this journey if he weren’t sure that he was eligible to run.

Any child hereafter born out of the limits and jurisdiction of the United States, whose father or mother or both at the time of birth of such child is a citizen of the United States, is declared to be a citizen of the United States: but the rights of citizenship shall not descend to any such child unless the citizen father or citizen mother, as the case may be, has resided in the United States previous to the birth of such child. In cases where one of the parents is an alien, the right of citizenship shall not descend unless the child comes to the United States and resides therein for at least five years continuously immediately previous to his eighteenth birthday, and unless, within six months after the child's twenty-first birthday, he or she shall take an oath of allegiance to the United States of America as prescribed by the Bureau of Naturalization." (Section 1, 48 Stat. 797.)
Even if the credential isn't sought (but Cruz has a CRBA, I take as a matter of informed faith), the same conclusion of "citizen at birth by operation of a statute" would be found by a competent court, on evidence that the statutory conditions were met.
That's one of the things that bothers me most. Barry wasn't eligible even though born here, but I'm beginning to wonder if Cruz's running isn't to both provide cover for Barry's backside and stretch the definition of natural born even FURTHER away from it's Constitutional roots.
Cruz being *declared* eligible would increase the pool of foreign born citizens/children eligible for the presidency exponentially.
He released his Canadian birth certificate. He proved he was NOT born in America.
