Kim Davis went back to work as a Kentucky county clerk last week after a stint in jail and a pledge that she wouldn't interfere with deputies who were issuing wedding licenses to same-sex couples.
But in a court motion filed Monday, the American Civil Liberties Union said that she was doing just that.
After returning to her job on Sept. 14 as the Rowan County clerk, the filing said, Davis "immediately" began meddling with licenses that the office's deputy clerk, Brian Mason, was issuing.

The ACLU, which is representing several couples who are suing Rowan County, called this "significant" interference that has "violated" a federal court order and "resulted in material alterations to those licenses that render their validity questionable at best."
The group is requesting that an older, unmodified version of the county's marriage license be used.

None if it was really just about getting a marriage license.
It would seem that it doesn't matter what the form looks like as long as it is issued by the county.
This is purely prosecution of an individual.

The form shall provide for the entering of The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license. KRS 402.100(1)(c)
KRS 402.110 Marriage license to be uniform and completely filled out. - The form of marriage license prescribed in KRS 402.100 shall be uniform throughout this state, and every license blank shall contain the identical words and figures provided in the form prescribed by that section.
Rowan County is not the name of the Rowan County County Clerk. Listing Rowan County as the name of the County Clerk is a violation KRS 402.100(1)(c), 402.110.
The gays want to have a trophy license to hang on their wall, just like a moose head with big antlers.
The deal was that she would allow her deputies to issue them if her name wasn’t on them.
This proves that the licenses were never the issue — licenses with her name on them were always the goal. That’s why her original stance was prudent — no marriage licenses for anyone — and BTW, fully supported by the very logic of the Obergefell decision.
According to a strict reading of the statute, if it said "Kim Davis", that's a violation too, unless the marriage licenses of every other county in the state say the same thing.

Exhibited below is a properly filled marriage license. The date issued is "6/16/2015", the place issued is "in the office of KIM DAVIS, ROWAN COUNTY County Clerk, MOREHEAD, Kentucky", and the signature of the county clerk or deputy clerk issuing the license is "BRIAN MASON, DEPUTY CLERK"

Do the altered licenses provide for entering the date and place where the license was issued, and a place for the clerk's signature?
