Cruz: Excluding Muslims from presidency is unconstituional

It would be unconstitutional to disqualify a Muslim from the presidency because of religion, Republican presidential candidate Ted Cruz said Sunday.

“You know, the Constitution specifies there shall be no religious test for public office and I am a constitutionalist,” the Texas senator said during the taping of “Iowa Press” at Iowa Public Television.

Cruz was about Ben Carson’s televised statement that Islam is inconsistent with the U.S. Constitution. “I would not advocate that we put a Muslim in charge of this nation. I absolutely would not agree with that,” Carson said on NBC’s “Meet the Press.

Cruz also referred to the ongoing controversy raised in the media over whether Donald Trump should have corrected a man who incorrectly stated at a rally that President Obama is a Muslim and not an American. “My view, listen. The president’s faith is between him and God. What I’m going to focus on is his public policy record,” Cruz said.

One area in which Cruz did not mind excluding Muslims, however, was from the ranks of refugees from Syria seeking asylum in the United States. He said they should settle in other Middle Eastern countries, citing concerns that some of the purported refugees may actually be terrorists.

“I think the Christians are a very different circumstance because Christians are being persecuted, they are being persecuted directly for their faith and the Obama administration has abandoned Middle East Christians,” Cruz said.

Several other Republican presidential candidates weighed in on the issue of Syrian refugees Saturday during a forum in Des Moines. Mike Huckabee agreed with Cruz that the U.S. should exclude Muslim refugees but accept Christians. Rick Santorum argued that even the Christians should be assisted in the region so they can return home when the violence ends.

Following his visit at Iowa Public Television, Cruz visited with restaurant-goers at the Machine Shed Restaurant in Urbandale for more light-hearted discussions while Iowans enjoyed their morning brunch.

yes I do so imagine...., given that Obama (and even Bush2) brought so many thousands of Muslims in from all 57 of their Krapistans... there must be a few who are not anti-American or even anti-Christian (just statistically speaking there are often ‘outliers’ in any group)...
but alas, we also can read their Koran and listen to how their (Saudi/Omani/etc) funded imans preach hatred or opposition to us

so... it remains a serious, serious problem for America and our future as a “land of liberty”.... the most serious problem in my limited lifetime (having been born after WW2)

Wake up. There are no analogues between Islam and Catholicism and nobody is arguing for a religious test by government. This is a game played by the MSM and Cruz should not have played.

Excluding moslems may be unconstitutional, but if the people are dumb enough to elect a truly practicing mohhammedan, soon there will not be a Constitution to worry about.

That is true but that fault lies with the people not the Constitution. The document was not intended to prevent or cure stupidity.

Trump spoke at a high school and told a student he loves Muslims, and that he would have absolutely no problem considering one for his cabinet or his ticket.

Prohibition - imposed by a constitutional amendment - did not survive the reaction of public opinion.

I get your point, however it is not the same thing.

You're equating those who operate within the constitution to those who would like to see it destroyed.

islam is no more interested in the constitution than the progressive liberal slime and the coward "opposition" is.

Your point, is predicated on a law abiding and committed to law society, it simply cannot apply to this argument.

IF it's true that Muslims swear their oath to Mohammed and Sharia NOT our Constitution that makes Ben Carson right, IMHO.

Admittedly, I don't know enough about Islam to say for certainty that Mohammed and Sharia always come first.

45 years ago, I attended a Catholic university (Seattle U), and at that time I'd say about 75% of the Jesuits at the school were conservative. Nowadays, Seattle U is not even liberal, it is far-left, maybe even more so than the University of Washington.

The amendable Constitution’s prohibition on religious tests doesn’t take into consideration Muslim extremist revenge against Christians imo, such revenged evidenced by the Treaty of Tripoli, as a consequence of the Christian Crusades.

Also note that religious differences can be the motive for giving aid or comfort to enemies of the USA, Section 3 of the 14th Amendment prohibiting such people from holding office.

Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof [emphases added]. But Congress may by a vote of two-thirds of each House, remove such disability.

Otherwise, what am I overlooking?

She added,.... "They destroyed our farm, the campagna! They burned our two barns, slaughtered the animals for the hell of it, and then stole the tractor and moved on. They are worse than locusts!"...

This is one woman's story of what's going on in Sicily....you don't hear that on the news because all is hidden to evoke sympathy for the invaders.

Here Riot police had to be called in for they were breaking into anything to steal and rob.

Besides, your Cruz birtherism has been laid to rest on this forum, even by the owner. It really doesn't merit serious response.

The proper question is, "Is Islam a religion in the sense of the Constitution?" To "cut the Gordian Knot," admit that, just as under Islam our Constitution (and ANY other legal system but Sharia) is Haram, Islam is Unconstitutional
