Huckabee was the first to announce he would go to Kentucky. I give him kudos on this issue.

I think he’ll up the ante and start levying crippling fines intended to destroy her personally.

If he fines her then it'd take all of a day or two for a Go-Fund-Me site to be set up and collect enough to pay off whatever fine he levies on her. He said last week that that was why he was going to jail her. He did it once, he'll do it again.

402.110 Marriage license to be uniform and completely filled out.

The form of marriage license prescribed in KRS 402.100 shall be uniform throughout this state, and every license blank shall contain the identical words and figures provided in the form prescribed by that section. In issuing the license the clerk shall deliver it in its entirety to the licensee. The clerk shall see to it that every blank space required to be filled by the applicants is so filled before delivering it to the licensee.

402.100 Marriage license -- Marriage certificate -- Confidentiality of Social Security numbers.

Each county clerk shall use the form prescribed by the Department for Libraries and Archives when issuing a marriage license. This form shall provide for the entering of all of the information required in this section, and may also provide for the entering of additional information prescribed by the Department for Libraries and Archives. The form shall consist of:

(1) A marriage license which provides for the entering of:
(a) An authorization statement of the county clerk issuing the license for any person or religious society authorized to perform marriage ceremonies to unite in marriage the persons named;
(b) Vital information for each party, including the full name, date of birth, place of birth, race, condition (single, widowed, or divorced), number of previous marriages, occupation, current residence, relationship to the other party, and full names of parents; and
(c) The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license.

Don't use GoFundMe. They cancelled the fundraising for Christians that were attacked for refusing to participate in homosexual weddings. Better to go through Samaritan's Purse.

Exactly what I thought. I hope the rally goes on, and Cruz says his piece as well. There's no way Davis should have been thrown in jail over this... I'm still pissed off, and I'm sure the vast silent majority is as well.

Ridiculous - he has no jurisdiction as Federal judge to issue that kind of an order, nor any of the others. If there is an issue with the conduct of a state official fulfilling state duties, a state court must adjudicate. And as far as I can tell, her counsel has made no effort to make this argument.

Thank you for providing the law. I see its not her signature that is the most troubling if I were her. It is this

How does a person of conscience sign that authorization? I could see simply signing the form but to be the person to authorize to unite the persons in marriage is a whole other thing to put ones signature to.

Interesting. I thought the clerk had to sign. If the deputies can sign, then that resolves the issue. Her signature is not needed, and she doesn't have to violate her beliefs. The deputies that agree to sign can deal with their own salvation...

So basically Trump called this one right again. I’m not arguing the constitutionality of the SC, what they can and can’t do, if people should follow the ruling or not. Simply stated,Trump said that someone else in the office should do it or gay couples can get to another county to get it issued. Seems to be that has been the outcome. Whether or not the USCC acted lawlessly or not, the issue should have always been insofar as Kim Davis is concerned at this point in time, is that she should have what in effect amounts to conscientious objector status. Again, Trump was right.

This line of argument may be running out of steam, as according to KY 61.035;

“Any duty enjoined by law or by the Rules of Civil Procedure upon a ministerial officer, and any act permitted to be done by him, may be performed by his lawful deputy”

The deputies are empowered to carry out the functions of the office if the head is not present.
