PORTLAND, Ore. A Marion County judge has refused to perform same-sex marriages and has asked his clerks to refer couples seeking same-sex marriages to other county judges.
Judge Vance Day, a circuit court judge and former chairman of the Oregon Republican Party, is now facing an ethics investigation over that decision, according to the judges spokesman.
Spokesman Patrick Korten said Day instructed his staff to tell couples that the judge will not perform same-sex marriages. The staffers were instructed to refer same-sex couples to other Marion County judges willing to issue them a marriage license.
Korten said Day took the action based on his deeply-held religious beliefs.
Its an exercise of his religious freedom rights under the First Amendment, Korten said.
Day hasnt performed any same-sex marriages since he joined the bench in 2011, but only stopped doing marriages of any kind this past spring. Judges in Marion County are not required to perform marriages, and Marion Countys website lists five active judges and one retired judge who are available for marriage ceremonies.

America needs more brave people to defy the evil central communist government.
Good. Kim started a movement.
Let Jerry Brown and Kamala Harris explain why malfeasance on a State wide scale is their right but others have to go to jail.
It appears a lot of Americans have decided not to join the circus freak show.
Bless him. I am glad he did not just quit.

Another brave American refuses to play along with the Gay Mafia’s charade.
Perp-walked in chains to Federal dungeon in 3... 2... 1...
Go, Judge, GO!!
American Civil Court Judges .... Doing the spiritual Leadership jobs that Rev. Franklin Graham and 100,000 COWARDLY and GUTLESS Christian Pastors .... refuse to do ...
Yes, it’ll be interesting to see if any pastors mention the Christian civil disobedience taking place over homosexual marriage tomorrow during their services.
And many still insist on siding with liberals. Sadly.
My great-great-great-grandfather was married in Marion County in 1853, 6 years before Oregon became a state, after his first wife (my ancestor) died on the Oregon Trail. I don’t know if he married his second wife for her looks or because her first husband had acquired land there, which they lived on after the wedding.
When brave people stand up WE have to support them in every way possible.
Isn’t it a fact that there really is no definition of marriage anymore???
Work with me here. The Supreme Court, in June 2015, overturned all marriage laws which defined marriage as a man and a woman. But, what is the definition of marriage now??? Everyone assumes that marriage is now just any two people, but is it really?? I mean legally speaking, was the legal definition of marriage changed????
The Supreme Court decision on marriage in 2013 overturned the federal definition of marriage, and instead, mandated that the federal government accept the definition of marriage as defined by the states.
But now the 2015 ruling is that states cannot define marriage any longer as a man and a woman. But the ruling did not mandate that marriage was any two people. The ruling did not define marriage at all.
So legally, is there any actual definition of marriage anymore anyway???
Let Jerry Brown and Kamala Harris explain why malfeasance on a State wide scale is their right but others have to go to jail.
The reason is that there are different criteria for evaulating situations, depending on whether it is in support of a liberal cause.
IN the case of Harris and Brown, they wanted to prove they are liberal, and decided not to defend California marriage law in court. They were supporting a liberal position by their actions, so it is ok, per liberal criteria.
Since Kim Davis is doing something which runs against the movement for the liberal cause of homosexual marriage, she is in jail as liberals decide in her case, that we must strictly uphold the rule of law as they see it.
“Day hasnt performed any same-sex marriages since he joined the bench in 2011, but only stopped doing marriages of any kind this past spring. Judges in Marion County are not required to perform marriages, and Marion Countys website lists five active judges and one retired judge who are available for marriage ceremonies.”
So he doesn’t marry ANYBODY, he’s not REQUIRED to marry anybody, and there are SIX other judges available to marry people.
How can this possibly be a problem?
RE: How can this possibly be a problem?
It isn’t. In fact even in Kentucky it never was a problem. Gays could go to neighboring counties or even go to a judge who was willing to officiate their marriage.
Even in the case of the Colorado Christian Baker, there were many other bakers willing to bake the gay wedding cake.
It’s not and never about the license. It’s about COERCION. It’s about FORCING devout Christians to conform.
I fear that, within the next five years, legislation will be put into place declaring that religious ceremonies will no longer be recognized. Only a civil ceremony will be considered valid for legal purposes.
Getting out the popcorn.
