In papers filed in New Jersey Federal Court, Harris Faulkner says shes suffered substantial commercial and emotional damage from a plastic hamster doll that shares her name.

And not one of the other Fox anchors — not Shannon Bream or Ainsley Earhardt or even Julie Banderas. Is Hasbro racist, saying a black anchorwoman is the equivalent of a hamster?

Is there any merit to Faulkners legal claims? Section 43(a) of the Lanham Act protects the names of celebrities in a manner similar to trademarks. Liability may arise if the plaintiff can establish that the defendants use would cause consumers to mistakenly believe that the plaintiff has endorsed or approved the defendants goods.

Agreed. It's not like it's a common name. Or like it's a natural name for some small animal. Somebody picked her out for some reason -- either they're attacking her or exploiting her.
If she doesn't mind paying lawyer's fees, I don't have a problem with her suing. Stuff like this may clog the courts and slow down other cases, but that's not always a bad thing.

I agree in part with with Procon: She's a professional who anchors the weekend newscasts and now has her daily Fox News show ("Outnumbered"). I disagree with him regarding her lawsuit - her name is her brand; I'd hate to see the reaction to Hasbro coming out with a Hillary or Obama toy rodent (though it would certainly be more appropriate for both).
News reporter turned anchor who works at Fox News for 9 years. Used to work three years on Current Affair and at stations in Minneapolis, Kansas City and Greensboro. She once had a stalker that lead to a book and appearances on talk shows.
