Retired Four-Star General Jailed Over Chinese Takeout

A retired four-star U.S. Army general was out on bond Tuesday after being taken to the Fayette County jail over the weekend for allegedly ordering Chinese food without paying for it .....

....... Fayetteville police Chief Scott Pitts said that after his order from the Royal Chef restaurant arrived at his home, Livsey tried to pay the driver with a debit card that was declined. When Livsey offered to pay with a check instead, the driver told him checks were not accepted by the restaurant and he would have to take the food back, the police chief said.

That is when Livsey allegedly grabbed the driver's throat and facial hair, pushed him and pinned him against a refrigerator in his kitchen. During the assault, police said, two people in the home took the food, placed it on a counter and began eating it.

Officers went to Livsey's home in the 200 block of Carriage Chase.

As officers tried to handcuff him, Livsey resisted, according to the police chief. The struggle created a small laceration on Livsey's arm. Fayette County EMS was called to the scene to treat the injury and police tried to handcuff Livsey again.

The police chief said Livsey tried "to punch one of the officers and kick another one all while making threatening and disparaging remarks."

The retired commander said there were several guests at his house at the time of the incident. He said he sent his assistant to the restaurant to pay for the food and give the driver a tip. Livsey also said Royal Chef wanted to drop the incident but the Fayetteville police made "a spectacle of it and a spectacle of me." ........

That puts a different spin on it. If I read the story correctly, the article said:

"Bedgood said that Irvin told the captain that the general had never touched his neck, only his arm."

Now that we have a dispute as to the facts, I will have to rethink my original take on this case.

I think this is going to have to be put in front of a jury.

How would the delivery driver know the customer is retired military? He would know elderly.

At that point I'd have called the boss if there was a question about accepting a check.

Reminds me of a mildly humorous experience at a restaurant I used to own.

cranked their security up too tight and I was 100 miles away from my usual haunts

That happened to us in Laughlin, NV a couple of years ago (200 miles from home); wifey was buying a pair of shoes at the Outlet Stores and the Discover card got declined (even though their history should have shown we've been there a half dozen times).

The sales clerk said this has become quite common, and a thirty second security-check phone call from the store fixed it.

Now, however, if we're gonna be traveling, I call ALL of our card companies...

I went through OCS in 76. Livesays Son was in my platoon. We kept bottom fiveing him each week. We couldn’t understand how he made it. After we graduated we found out who his Dad was! Years later I had to brief him, he was a three star at the time. After the briefing I asked him how his son Tim was doing? He looked me and mumbled something uncomplimentry!

Credit card companies are the new internal passport tracking system, it seems. Couple that with the locator on your phones, traffic cams, and maybe an EZ-Pass transponder, and any normal modern person leaves a wide trail behind him.

Nothing to hide here, but it’s creepy, nonetheless.

I would be surprised if the DA even took up the case.

If the victim is refusing to press charges, I very much expect the DA to drop it. That is probably the best way to put this to bed, though I think the officer's feelings might get hurt.

Here it is pure and simple:
Eyewitness says police still have not asked what he and other witnesses saw; victim tried to withdraw complaint, but police refused

Cops say retired 4-star general choked delivery driver, resisted arrest; eyewitness says cops over-reacted, dispute didn’t happen the way warrants allege.

William “Bill” Livsey, 84, of Fayetteville, a retired four-star general and Silver Star recipient for heroism, ordered home delivery for himself and three other companions from a Chinese restaurant just before 7 p.m. Aug. 15.

Within a couple of hours that Saturday night, the highly decorated retired officer was handcuffed with bloody arms inside a Fayetteville police unit on his way to be booked into jail on charges including theft of services, two counts of obstruction of officers, simple assault, terroristic threats and acts, as well as a felony charge of robbery, according to magistrate court warrants and police reports.

Livsey’s bail bond was set at $12,000.

Following questions from The Citizen, Police Chief Scott Pitts, City Manager Ray Gibson and Mayor Greg Clifton have released their side of the story.

The general’s personal caregiver and driver, Tim Bedgood of Sharpsburg, gives a sharply different version of events.

Bedgood charges the multiple officers (“seven cop cars and nine officers”) mishandled the complaint, including handcuffing the 84-year-old so tightly his wrists bled.

The official version “is not accurately portrayed,” Bedgood said, adding that he and two women were in the home from the time the call for takeout was made until the takeout delivery driver left the home.

Bedgood said he left to pay the food bill in person at the restaurant, and when he returned, police in force had Livsey in cuffs outside with individual police units stationed at several intersections in the neighborhood.

Have you heard anything further as to how the son ended up?

Probably grew up as an entitled brat, and that is why he didn't do so well in OCS.

So none of his guests had cash or a credit card number to phone in to the restaurant? I find it kind of hard to believe that no one in the house had any other form of payment. Sounds like alcohol may have been a contributing factor here.

He did try to pay with plastic but there are a few places that don’t accept it. Sounds out of character. Might be something medical going on

Just dang - 9 cops and 7 cop cars to answer this complaint. My my, don’t we all feel safer now? Completely different story for sure. This is the one that should have been posted.
