WORCESTER (CBS) Marianne Diaz and her fiancé, Bryant Alequin, felt their lives were in danger when a SWAT team raided their third-floor apartment on Hillside Street with guns drawn.
Diaz says she grabbed her seven-year-old and 18-month-old girls and prayed while Worcester police officers and State Police troopers executed a search warrant.
It was terrorizing, and the worst thing Ive ever been through in my life. They were loud, vulgar, and disgusting in behavior, she said.
It happened on Wednesday around 5:30 in the morning.
Alequin says he was in the bathroom getting ready for work.
I was scared, honestly. They put me in handcuffs, they were very tight, and it was ugly, he said.
Turns out they were not the people police were looking for.
I just want there to be a full-on investigation, and give us an explanation as to why they did this to my family and why they terrorized us the way they did, Diaz says.
The familys attorney, Hector Pineiro, says his clients rights were violated.
You can imagine 10 officers looking and pointing guns at a naked 23-year-old mother protecting her two kids. The horrific language and pointing of weapons at children cannot be justified under any circumstances, he said.
Police have raided the apartment before, but Diaz moved in back in May with her fiancé and two children.
The person that used to live there does have a criminal record, but Diaz and her family have never been in trouble with law.
They came into my house like that when they did not have their facts right, Alequin said.
The DAs office released a statement saying The search warrant was executed based on the best intelligence at the time. He (the target) had been in the dwelling in the days before the execution of the search warrant.
Pineiro strongly disagrees.
Its clear to me that the (district attorneys) office is not going to look into what happened because hes already giving the blessing they acted on the best intelligence, which is a complete joke, he said.
The family has not yet decided if they will file a lawsuit.

If cops can’t get the address in a search warrant right, makes you wonder what else in that warrant is screwed up.
I remember growing up my father walking around checking all the locks before going to bed at night. Jeez, nowadays you have to set the tripwire and made sure the pin isn’t too secure.

In its story, "SWAT team breaks into wrong Worcester house, residents say," the Worchester Telegram states:
"Ms. Diaz said she moved into the top-floor apartment of the three-decker at 17 Hillside St. in May with her fiancée, Bryant Alequin, and their mutual friend Joshua Matos.
"When the trio moved in, their landlord told them the apartment had been raided in the past, Ms. Diaz said, and that he had remodeled it to take care of the damage."On Wednesday morning, Mr. Matos, a 27-year-old employee of a Clinton powder coating company said, he was sleeping in the living room just feet from the door when police busted through one downstairs entrance and entered through another that was unlocked....
"Mr. Alequin said he suffered a minor back injury, and Mr. Matos said doctors told him his wrist which was fractured weeks ago but was healing was re-fractured.
"Nowhere in his affidavit does Trooper [Nicholas E.] Nason state that he had firsthand knowledge that Mr. Jackson lived in the apartment or that he conducted any surveillance on the property.
What kind of theory could have plausibly been there? The culprit had moved out months ago, which would not have been difficult to verify with the landlord. And the culprit had been taken to jail two weeks prior from a different home address.
Did these Inspectors Clouseau, these Keystone Cops, manage to believe that somehow he had kept the separate apartment up all this while, and so thought it was perfectly reasonable to arrange to barge in there seeking paraphernalia. And what judge bought the notion, asking no questions? Is this any semblance of a justice system any more, or just a rubber stamp machine?

Judges who issue no-knock warrants just because police ask for them ought to be out of office.
And subject to a surprise no-knock warrant and handcuffing sometime.
Even for a swatting, something semi-plausible needs to be alleged. This sounds like an internal thing, which bypassed the usual screening that a random call from the public would get.
I’ve lived in MA all my life. Its terrible here. Almost everyone is a Liberal jerk. You won’t like it.
If liberals were only actually liberal, they wouldn’t be a problem. The problem is that they are for show, they pay some visible dues, then they compensate by being as mean as the devil in everything else.
You can serve a search warrant without dynamic entry. In fact that used to be SOP.
Acting like the evil culprit was still there and holed up ready to attack. Yeah the one they had in jail since two weeks prior... THAT evil culprit.

Of course, the felon had already been arrested. So whatever they didn't do in the two weeks from the arrest to serving the warrant is just plain incompetence.
Because weapons were used that very well could have easily maimed, crippled or even killed someone, then whoever is the incompetent person or persons should be fired with prejudice. They do not deserve to have jobs with such a heavy responsibility when they show such gross dysfunction.
Also, I'm sure the wannabe Rambos all cussed and screamed and were generally thinking of themselves as alpha bad-asses. They all should be sent to Afghanistan.
Washington thru Patton used to fine men for cussing. The police need to police their potty mouths. If people are supposed to be “innocent until proven guilty”, they need to show decorum, even in a dynamic arrest.
You let them get away with what is perceived as inconsequential violations of the regulations and pretty soon bigger violations will be perceived as inconsequential, etc., etc. up the spiral we go. Pretty soon they think they're all Judge Dredd.
