If they can’t be, they are not under jurisdiction. Like someone who is a diplomat cannot be arrested and tried in the United States, because they are not under jurisdiction.
But if they CAN be tried and arrested, then they ARE under jurisdiction.
That’s what jurisdiction means.
Don't conflate one thing with another. If you had studied this subject, you would know that the legal system recognizes several levels of temporary jurisdiction and temporary allegiance.
Foreign students visiting the US are regarded as having a temporary allegiance to the society in which they are currently living. Illegal aliens are an invading force, penetrating into the interior without permission.
They are the responsibility of their own governments, not ours.
ALL Persons to be considered “Under the Jurisdiction of” have a requirement of being able to be charged with TREASON, If you are an Illegal Alien you CANNOT BE CHARGED WITH TREASON AGAINST THE UNITED STATES, you ARE NOT “under the jurisdiction of” You Have NO RIGHTS to have your offspring be citizens.
That’s why we can’t charge Ogabe with treason.
They are still under control of our law. They are under the jurisdiction of the United States. In Medellin vs. Texas, it was confirmed by the United States Supreme Court that we can try and execute an illegal immigrant because he is under our jurisdiction.
Change the Constitution and this all goes away!
Not being subject to US jurisdiction means they are not bound by the responsibilities that citizens have, like jury duty, getting a passport to travel outside the country, voting, etc. It does not mean you can ignore the law if you’re not a citizen. The way you are interrupting it there would be no reason to put those words in the amendment. They would mean nothing.

It’s not a right which accrues to the illegal parents. The quote indicates that it is a right which accrues to the child which is born here.
So were those invading German Soldiers, but we didn't make citizens out of their children, now did we? Oh, but wait! They didn't have any because WE EXECUTED THEM.

Why are the words there? Because there are several categories of people who would not be under the jurisdiction of the United States.
-Diplomats
-Native Americans on their tribal lands
-Enemy Combatants
The Supreme Court has ruled on this issue in many, many, many cases. And yet I see a lot of supposition and explanation of how the word “jurisdiction” means something else.
But no links or quotations from cases or law.
Just made up crap that I would expect from liberals who find things like gay marriage and abortion in the Constitution.
The Constitution is clear. We need to change the Constitution to fix this, not make up crap like liberals.
