As the Hillary email scandal deepens, Team Hillary has to figure out how to deal with it. Richard Cohen in the Washington Post has already deployed the usual Clinton partisan "LOL this is silly and a waste of time" defense.
But there are serious legal issues that aren't going away. So it may be time to roll out the Benghazi solution. Fake fire a bunch of lower ranked people. Here's a preview of Option 2.
"Hillary only used her personal account for unclassified email. No information in her emails was marked classified at the time she sent or received them," campaign Communications Director Jennifer Palmieri said in a statement to supporters Wednesday.
But a State Department official told Fox News that the intelligence community inspector general, who raised the most recent concerns about Clinton's emails, made clear that at least one of those messages contained information that only could have come from the intelligence community.
"If so, they would have had to come in with all the appropriate classification markings," the official said.
The official questioned whether someone, then, tampered with that message. "[S]omewhere between the point they came into the building and the time they reached HRC's server, someone would have had to strip the classification markings from that information before it was transmitted to HRC's personal email."
The official said doing so would "constitute a felony, in and of itself. I can't imagine that a rank-and-file career DOS employee would have done this, so it was most likely done by someone in her inner circle."
The messages apparently contained satellite imagery and signals intelligence, information that diplomats cannot unilaterally obtain.
Yet, like the Clinton campaign, the State Department public affairs team also maintains that the emails were "not marked classified" when Clinton received them.
"None of them were classified at the time," department spokesman Mark Toner said.
The usual Clinton strategy comes in three parts.
1. We didn't do anything wrong
2. We didn't know we were doing anything wrong
3. You can't prove we knew we were doing anything wrong
You can see elements of all three here. The Clintons understand the lawyer game of plausible deniability well enough. Everyone knows they did X, but they just have to create enough doubt to make it hard to prove it. They're obviously lying, but... it could have been (a) a miscommunication (b) someone else's fault (c) a mistake.
Clintonworld is so huge that the Clintons can easily find some people to sacrifice. They've been amassing people and paying them through the Clinton Foundation. So they can always hand someone a golden parachute. If Sandy Berger was willing to stuff classified documents into his clothes, they can find someone to take the fall for Hillary's emails.
Chris Cristie has tried the blame aide defense but without success.

State Department knows that, FBI knows that, DOJ knows that and anybody with a security clearance knows that.
These headlines are for the uninformed public.
My concern is that now the server is in the hands of the DOJ as part of an investigation, any info related to them are not subject to FOIA nor congressional subpoenas.

Absoluetly right. Just for the sake of discussion, suppose one of her aides had removed the "Top Secret" markings from the emails before Hillary saw them. What possible reason could they have for doing that? As soon as Hillary saw the content, she should have immediately known that this information fit the criteria to be marked as "Classified", "Top Secret", etc., and demanded to know why this wasn't done.
And, What consequences did Burger actually suffer for his felonies?
Practically none, other than pleading to a misdemeanor, and being a laughing stock (outside the inner circle).
Neither of the Clintons will ever serve one of the many richly deserved years in prison.
Prison is for the little people.
However, this email dust up may be the straw that breaks the camels back and absolutely denies Hillary! any chance at the presidency.
It could also diminish Bill’s ability to raise money because he would no longer have influence.
In the end, that would be as devastating to the Clinton Cartel as prison.
Imagine spending a lifetime using every dirty trick in the pursuit of power, using and abusing people with no regrets.
And in the end you are rendered irrelevant and ineffectual.
Not even the pretense of power.
Shallowly marking out your remaining days with only the friends your money buys you, and being shackled to a spouse who despises you.
One spending his days gulping viagra by the handful while yearning for his glory days.
The other pickling herself with liquor bemoaning her fate because her feminine companion has left because she is of no further use.
One a washed up, pale imitation of himself.
The other a sad never was.
Could prison really be any worse for either of them than that?
She should have done that to start with.
Promise the aide a short punishment through paid off judges.
Promise the aide to take care of them the rest of their life.

You're not thinking big picture here. Who was the one sent to Benghazi to intimidate Witnesses from talking to Congressional Investigators/House Members about the attack and the lack of response from State? Who is/was Hillary's Chief of staff? Answer to those questions is the one and only Cheryl Mills.

A low level aide stripped the Top Secret designation from Hillary's emails?
If that is the case, then Hillary committed a felony by allowing a low level staffer without a proper security clearance unsupervised access to Top Secret information.
BTW, just what is the security clearance of the small IT company in New Jersey that had physical custody of the Hillary Clinton email server that contained highly classified secret information and how was that secret information secured ?
This just keeps getting worse and worse.
No excuse possible for this . Hillary is an Ivy League lawyer who was listed as one of the Top 100 layers in the county. She was First Lady for 8 years and a member of the Senate Armed Services Committee for 8 years as Senator so she has been thoroughly briefed on the classification and handling of confidential and secret government information. She was further indoctrinated in classification of secret information for her job of running the Dept of State. There is simply no way she can play the victim on this one.
Sandy Berger and Sid Blumenthal were working for her too.
I wonder how much Hillary was charging foreign counties for assess to her server.
